建设工程项目施工合同索赔管理研究

【摘要】：近年来,我国的建筑市场经济因其快速的发展在不断发生变化,越来越大的工程规模项目产生了越来越复杂的工程实施环境,各式各样的风险因素在此环境中滋生发芽,导致建设工程施工合同在履行过程中存在各式各样的问题,如果不能十分恰当地处理此类问题,很可能会影响到合同双方的合作。所以划分清楚合同双方的责任在我国建筑市场中是极其重要的,这要依赖于签订的合同文件。施工索赔事件发生在合同履行过程中的各个阶段,需要在以合同文件为依据的基础上进行处理,索赔管理在合同履行中的作用举足轻重,能够更加合理的处理双方的利益冲突。合同管理索赔的应用即是本文研究的主要内容,这对于承发包双方以及规范我国建筑业发展都具有重要的意义。本文首先对我国建设工程项目施工合同管理的现状及管理中的不足进行了剖析,然后更加地深入详细地研究了施工过程中不可避免会遇到的的索赔管理,建设工程项目施工合同管理工作的最重要的一项工作就是索赔管理。本文首先对索赔的定义进行概括,介绍索赔工作的标准操作程序,总结出了索赔管理工作的重要意义。最后本文通过分析真实的合同管理索赔案例,证实了索赔管理在施工合同管理中甚至于企业管理中的重要性。通过分析我国建设工程合同索赔管理现状,依据实际案例研究合同索赔中工期的详细计算过程。衷心希望我国经济的快速发展促使我国建筑市场将向国际全面打开。
[Abstract]:In recent years, the construction market economy of our country has been changing constantly because of its rapid development, and more large projects have produced more and more complex engineering implementation environment, and all kinds of risk factors have sprouted in this environment. As a result, there are many kinds of problems in the process of construction contract performance. If this kind of problem can not be dealt with properly, it may affect the cooperation of both parties. Therefore, it is very important to define the responsibilities of both parties in the construction market of our country, which depends on the contract documents. The construction claim event occurs in all stages of the process of contract performance and needs to be dealt with on the basis of contract documents. Claim management plays an important role in the performance of the contract and can deal with the conflict of interest between the two sides more reasonably. The application of contract management claims is the main content of this paper, which is of great significance for both contracting parties and standardizing the development of construction industry in China. This paper first analyzes the present situation of construction contract management of construction projects in China and the deficiencies in the management, and then makes a more in-depth and detailed study of the claims management that is inevitable in the construction process. The most important work of construction contract management of construction project is claim management. In this paper, the definition of claim is summarized, the standard operating procedure of claim is introduced, and the significance of claim management is summarized. Finally, this paper proves the importance of claim management in construction contract management and even enterprise management by analyzing real cases of contract management claims. Based on the analysis of the present situation of the claim management of construction contract in China, the detailed calculation process of the time limit in the contract claim is studied according to the actual cases. Sincerely hope that the rapid development of China's economy will promote the opening of our construction market to the international.
