新型城镇化背景下小产权房法律问题探究

【摘要】:最近这些年来,在我国各大城市小产权房的交易受到一些中低收入的城市购房者的关注。早在上个世纪后期随着城镇化扩展的不断加速,小产权房的问题渐渐浮出水面。当前社会关注的焦点问题纷繁复杂,小产权房的法律问题是其中比较重要的一个。小产权房问题阻碍着新型城镇化的发展,也对新型城镇化目标的实现产生阻碍。在新型城镇化的背景下需要尽早解决小产权房的问题,从立法层面上,应当从有效实施新型城镇化战略的高度,围绕解放生产力和发展生产力、为广大民众的创造幸福的这两个伟大目标,通过立法制定与小产权房相关的法律法规;从司法层面上,严格制定与小产权房的相关法律程序,区别不同类型的小产权房的定义,小产权房交易合同的效力问题亦需要明确的界定。当前国家的法律对小产权房的地位没有明确界定,法律也没有认可小产权房是合法的,某些国务院政策性的文件与法律法规的原则性规定并不是一致的,甚至有可能相矛盾。在我国的司法实践中,小产权房向非本集体组织成员出售后的买卖合同的效力的认定是一个非常复杂的问题,并且在小产权房的所有权归属问题上也存在着很大的分歧。关于新型城镇化的建设的宏伟目标,中国共产党第十八届三中全会在《关于全面深化改革若干重大问题的决定》中做出了重要的决定,这项决定不仅指出了中国新型城镇化的建设的方向,而且为打破制约着新型城镇化建设的许多障碍提出了明确的要求。小产权房问题会对政府的信用、法律的权威和民众的福祉产生负面的影响,也会对农村集体建设用地使用权直接进入市场以及农村合法取得土地使用权的正常流转产生影响,成为新型城镇化建设背景下不可回避的现实问题和法律问题。如果不能有效解决这些现实问题和法律问题,那么推进以人为核心的城镇化将是一句空话。小产权房问题不仅与新型城镇化的要求不相适应,也影响和阻碍着新型城镇化目标的实现。因此,探究有效的解决小产权房的法律问题的方案,对于促进新型城镇化建设战略的有效实施,创造广大民众的福祉是当务之急的。
[Abstract]:In recent years, small property transactions in major cities in China have attracted the attention of some low- and middle-income urban buyers. Early in the late last century, with the acceleration of urbanization, the problem of small property housing gradually surfaced. The current focus of social concern is complex, the legal problem of small property rights is one of the more important. The problem of small property right hinders the development of new-type urbanization and hinders the realization of new-type urbanization. Under the background of new urbanization, we need to solve the problem of small property right as soon as possible. From the legislative level, we should focus on liberating and developing productive forces from the perspective of effective implementation of the new urbanization strategy. The two great goals of creating happiness for the general public are to enact laws and regulations related to small property houses through legislation; from the judicial level, strictly formulate legal procedures related to small property houses, and distinguish between different types of small property houses. The validity of the small property right house transaction contract also needs to be clearly defined. At present, the state law does not clearly define the status of the small property house, nor does the law recognize that the small property right house is legal. Some documents of the State Council policy are not consistent with the principle provisions of the laws and regulations, and they may even contradict each other. In the judicial practice of our country, the confirmation of the validity of the sale contract after the sale of the small property house to the non-members of the collective organization is a very complicated problem, and there are also great differences on the ownership of the small property house. With regard to the grand goal of building a new type of urbanization, the third Plenary session of the 18th CPC Central Committee made important decisions in the "decision on several important issues of comprehensively deepening Reform". This decision not only points out the direction of the construction of new urbanization in China, but also puts forward clear requirements for breaking down many obstacles that restrict the construction of new urbanization. The issue of small property rights will have a negative impact on the credit of the government, the authority of the law and the well-being of the people, and will also have an impact on the direct entry of the right to use the rural collective construction land into the market and the normal circulation of the legal right to obtain the right to use the land in rural areas. It has become an unavoidable realistic problem and legal problem under the background of new urbanization construction. If these practical and legal problems cannot be solved effectively, it will be empty talk to promote the urbanization with people as the core. The problem of small property right not only does not meet the requirements of new urbanization, but also affects and hinders the realization of new urbanization. Therefore, it is urgent to explore an effective solution to the legal problem of the small property house for promoting the effective implementation of the new urbanization construction strategy and creating the well-being of the general public.
