中国《民法典》编纂中的习惯法问题

【摘要】：中国《民法典》编纂能否成就一部引领21世纪潮流的伟大法典,可能并不仅仅取决于或者主要不取决于编纂模式或者技术,而取决于该法典内容之思想深刻性与现实有效性。为达致上述要求,《民法典》编纂应立基于中国传统、生活及其未来发展。就此而言,习惯法问题对《民法典》编纂成败得失具有关键性意义,我们必须认真对待《民法典》编纂中的习惯法问题。澄清问题有助于解决问题,《民法典》编纂中习惯法问题之意蕴可适切地表述为"民事习惯法典化",又可展开为五个子问题:观念基础问题、具体路径问题、法源地位问题、要素构成问题、事实之规范意义问题。但该问题之有效解决,还须依赖最终汇聚于民法学术路径的多方智识努力。
[Abstract]:Whether the compilation of the Civil Code of China can achieve a great code leading the trend of the 21st century may depend not only or mainly on the mode or technology of compilation, but also on the ideological depth and practical validity of the contents of the Code. In order to meet the above requirements, the compilation of the Civil Code should be based on Chinese tradition, life and its future development. In this regard, the issue of customary law is of crucial significance to the success or failure of the codification of the Civil Code, and we must take seriously the issue of customary law in the compilation of the Civil Code. Clarifying the problem is helpful to solve the problem. The implication of the problem of customary law in the compilation of the Civil Code can be appropriately expressed as "the codification of civil custom", and it can be expanded into five sub-problems: the problem of concept foundation, the problem of specific path, and the problem of source status of law. Elements constitute the problem, the fact of the normative significance of the problem. However, the effective solution of this problem depends on the intellectual efforts that ultimately converge on the academic path of civil law.
