知识产权默示许可理论研究

【摘要】：知识产权默示许可理论,是我国知识产权制度中长期欠缺研究的领域。本文深入研究了美国和欧洲的知识产权默示许可理论,对于美国专利默示许可理论中的专利默示许可的测试方法,细分为以产品为基础的专利穷竭和其他类型的专利穷竭,包括禁反言、许可合同、组件销售、未完成部件销售、方法专利等多种情况进行了深入研究。对于美国版权法中的首次销售理论进行了研究,并且探讨了首次销售理论与数字市场自由化的冲突。通过这些研究,希望能够为我国知识产权默示许可理论的建立打下基础,促进我国知识产权默示许可理论的建立,从而保护我国企业在国际经贸和国际制造产业中的合法权益。
[Abstract]:The implied licensing theory of intellectual property is a long term lack of research in the intellectual property system in China. This paper deeply studies the implied licensing theory of intellectual property rights in the United States and Europe, and subdivides the product based patent exhaustion and other types of expertise to the testing methods of implied licensing in the implied licensing theory of the United States. The exhaustion, including the prohibition, the license contract, the sales of the components, the sale of the components and the method patent, has been studied deeply. The first sale theory in the American copyright law is studied and the conflict between the first sales theory and the liberalization of the digital market is discussed. Through these studies, we hope to be able to provide knowledge for our country. The establishment of the implied license theory of property rights has laid the foundation for the establishment of the implied licensing theory of intellectual property rights in China, thus protecting the legitimate rights and interests of Chinese enterprises in the international trade and international manufacturing industries.
