论宅基地使用权消灭制度
[Abstract]:The rural homestead system is a basic system which is directly related to the survival of hundreds of millions of farmers and the stability of the rural society. But in practice, the operation of the right to use the rural homestead is not satisfactory. There are many problems, such as the excess of the land area, the widespread inactivity of the house and the low recovery of the execution rate. The main reason is to improve the problem. At present, our country is actively carrying out the rural land deepening reform, and the homestead system is the key issue of the reform. In order to make the homestead reform in order and legal premise, we must complete the system of the right to use the house base from the aspects of theory and legislation. On the basis of the actual situation of the system of the right to use the land, the property property of the right to use the homestead is clarified, the basic rules of the change of the property right, the autonomy of private law and the balance of public interests are analyzed, and the reasons for the elimination of the right to use the homestead are explained and the problems existing in it are explained. It emphasizes the property property of the right to use the homestead. The change of the right to use homestead should abide by the basic rules of the change of real right and reduce the inappropriate administrative intervention. Under this concept, the system of the elimination of the right to use homestead should be perfected through the implementation of the registration system, the improvement of the relevant laws and regulations, and the construction of a fair and fair distribution of interests. The fourth part: introduces the problems existing in the elimination of the right to use the homestead, including the unreasonable recovery conditions, the low recovery execution rate, the unsolved problem of the homestead placement, and the neglect of the homestead expropriation. The fifth part: according to the present situation and the analysis of the existing problems in the first four parts, we put forward some perfect suggestions. The relationship between interests, respect for farmers' wishes, determination of reasonable compensation standards and improvement of interest distribution mechanism, and implementation of the elimination of registration system.
