民间借贷法律规制三十年进程与衍变

【摘要】：民间借贷是正规金融的有益补充。回顾民间借贷法律规制的进程与衍变,对重构规制理念、完善规制体系、促进民间借贷有序发展具有重要意义。本文以改革开放以来我国社会经济发展为背景,运用历史分期和事件分析等方法,将民间借贷法律规制划分为三个时期,研究各个时期规制进程和阶段性特征,即规制框架初步建立、模式基本形成、监管总体宽松的规制形成期,刑法规制框架基本建立、规制手段趋于完善、监管总体严厉的规制发展期,以及规制模式向激励型转变、监管松紧趋向适度的规制提升期。总结近30年民间借贷法律规制的衍变规律,总体趋向是规制理念走向成熟、规制范围更趋广阔、规制方式趋于灵活、规制体系逐步完善。
[Abstract]:Private lending is a useful complement to formal finance. Reviewing the process and evolution of the legal regulation of folk lending is of great significance for reconstructing the concept of regulation, perfecting the regulatory system and promoting the orderly development of folk lending. Based on the social and economic development of China since the reform and opening up, this paper divides the legal regulation of folk lending into three periods by using the methods of historical stages and event analysis, and studies the process and stage characteristics of the regulation in each period. That is, the preliminary establishment of regulatory framework, the basic formation of the model, the overall relaxed regulatory formation period, the basic establishment of the framework of criminal law regulation, regulatory means tend to improve, the overall strict regulatory development period, as well as the regulatory model to encourage the transformation. Regulatory tightening tends to moderate regulatory upgrading period. The general trend is that the concept of regulation moves towards maturity, the scope of regulation becomes wider, the mode of regulation tends to be flexible, and the system of regulation is gradually improved.
