网购消费者知情权保护法律问题研究
[Abstract]:With the rapid development of the Internet in the present era, the new type of network shopping consumption pattern also appears, and its low cost, efficient and convenient characteristics are deeply loved by the consumers. Many network trading platforms have come into being, such as the Jingdong mall, Taobao network, vip.com and so on, the establishment and rise of these network platforms, so that consumers are Under the condition of network, we can choose and buy their own products or services by browsing the web pages of these platforms anytime and anywhere. The convenience and shortcut of online shopping are well adapted to the fast pace of life today. However, when consumers browse the web and choose the goods and services they need, they often have to Through the information of the picture and text description of the goods and services provided by the network operator on the web site, it can't really touch or experience its products or services. In this way, the online shopper will be faced with the potential risk of misinformation, which is misled by false information. In the virtual environment of the network platform, the network consumer will not In view of this, the right to know of Internet consumers is more vulnerable to infringement. Therefore, we should pay more attention to the protection of consumers in the field of online shopping. Although China follows the trend of the network era. The development of the consumer rights protection law, which was revised in 2014, included the protection of the right to know of consumers in the network field within the scope of the law. However, because the legal regulation of the consumption pattern in the network field is still in its infancy, the revised law still has its defects and still needs to be further improved. In addition, there are no special laws and regulations in the current legal system of our country to regulate the network consumption. In view of this, this article is based on the social phenomenon that the consumer's right to know repeatedly in the field of Internet shopping, and studies the many related problems that the consumers' right to know in the field of Internet shopping from the legal aspect. On the basis of the causes of the problems, some suggestions are put forward to the legal protection of the right to know of consumers in the field of online shopping. The text is divided into four parts. In the first part, the first part expounds the basic theory of the right to know of the consumers in online shopping, and from the analysis of the traditional field. The meaning and content of the consumer's right to know, the basic theory of consumers' right to know in the field of online shopping, and the significance of protecting the right to know of consumers in the field by analyzing the importance of protecting the right to know of consumers in this field. The second part mainly analyzes the current situation of the protection of the right to know in China's online shopping, and points out that China's online purchase is protected. The problems of the right to know and the reasons for the problem are the theoretical basis for the following legal countermeasures. The third part is to discuss the relevant rule of law experience for the protection of the right to know of online shopping consumers abroad, and to analyze the foreign related rule of law experience on the protection of the right to know of the consumers in China's online purchase. The fourth part is the core content of this article, that is, the Legal Countermeasures of protecting the right to know of the consumers in China are obtained through the relevant theories of the previous article. First, the relevant provisions of the right to know of the consumers in China's online shopping are perfected from the legislative level. Then, from the institutional level to ensure that the right to know of the consumers is not infringed on the system level, and the main package is the main package. We should strengthen the information disclosure system, improve the credit evaluation mechanism and build the relevant regulatory mechanism to build three systems. Thirdly, we should restrict the industry itself and strengthen the self-discipline supervision of the industry. Finally, it is suggested to improve the awareness of the rights of the consumers in the net purchase, so as to reduce the birth of the tort and further guarantee the right to know of the consumers.
