游戏作品著作权保护问题研究

【摘要】:随着计算机技术的发展和移动终端的普及,电子游戏已经成为当下人们休闲娱乐的重要方式。巨大的游戏市场和潜在的消费人群让越来越多的开发商投身于游戏产业之中。在经济利益的驱动下,部分开发商大肆抄袭市场上的成功游戏。这种行为不但破坏了游戏市场的经营秩序,更是对游戏产业的健康发展造成诸多不利影响。现有的法律规范对游戏背后的软件代码进行了相应的保护,但极少对游戏的表现程序和运行界面加以保护。然而,游戏前台界面的著作权保护却是一个更加值得关注的问题。一方面,许多大型游戏的开发设计十分精美,游戏运行程序和界面的独创性已经达到了电影作品的水平,理应给予著作权法上的保护;另一方面,游戏领域的侵权纠纷主要集中在游戏运行界面之上,需要制定相应的法律法规,为评判此类纠纷提供充足的法律依据。本文中,作者首先通过介绍著作权法中“作品”一词的含义和内涵,明确著作权保护客体所应具备的基本条件,进而论证游戏属于著作权法上的“作品”。其次,作者从我国和世界上的游戏侵权案例入手,分析游戏作品著作权保护的现状和发展趋势。通过对这一趋势的总结和归纳,探求游戏作品的保护路径。再次,作者将结合司法实践成果,介绍思想/表达二分法、混合理论、场景理论等著作权法上的基本理论。通过实务判例阐述这些理论在游戏领域的具体应用,分析电子游戏的著作权保护范围和游戏中思想与表达的划分界限。然后,作者论证在判定游戏作品的运行界面侵权与否时,可以采用接触——实质性相似理论进行评判。最后,作者参考国内外司法案例,结合著作权法和反不正当竞争法上的相关规定,就游戏作品的著作权保护问题提出自己的观点和建议。
[Abstract]:With the development of computer technology and the popularity of mobile terminals, video games have become an important way of leisure and entertainment. The huge game market and the potential consumer crowd let more and more developers throw themselves into the game industry. Driven by economic benefits, some developers plagiarize the success of the game on the market. This behavior not only destroys the management order of the game market, but also has a lot of adverse effects on the healthy development of the game industry. The existing laws and regulations protect the software code behind the game, but rarely protect the game's performance program and running interface. However, the game front interface copyright protection is a more worthy of attention. On the one hand, the development and design of many large-scale games are very exquisite, and the originality of the program and interface of the game has reached the level of the film works, which should be protected by copyright law; on the other hand, The infringement disputes in the field of game mainly focus on the interface of the game operation, so it is necessary to make corresponding laws and regulations to provide sufficient legal basis for judging such disputes. In this paper, the author firstly introduces the meaning and connotation of the term "work" in the copyright law, and clarifies the basic conditions for the object of copyright protection, and then proves that the game belongs to the "work" of copyright law. Secondly, the author analyzes the present situation and development trend of copyright protection of game works from the game infringement cases in China and the world. Through the summary and induction of this trend, seek the protection path of game works. Thirdly, the author will introduce the basic theories of copyright law, such as thought / expression dichotomy, mixed theory, scene theory and so on. This paper expounds the concrete application of these theories in the field of games through practical cases, and analyzes the scope of copyright protection of electronic games and the division between ideas and expressions in the game. Then, the author proves that the contact-substantial similarity theory can be used to judge whether the game works are infringed or not. Finally, referring to the domestic and foreign judicial cases and combining the relevant provisions of copyright law and anti-unfair competition law, the author puts forward his own views and suggestions on the copyright protection of game works.
