网络游戏虚拟财产的侵权责任

【摘要】:‘目前我国的网络游戏虚拟财产侵权案件日益增多,但是相关的法律规定并不完善,对网络游戏虚拟财产的保护亦存在不足,本文主要探讨了侵权主体在侵犯了他人合法的网络游戏虚拟财产后所应承担的侵权责任的问题。本文将从网络游戏虚拟财产侵权责任的基本理论、侵权责任的承担类型、侵权责任的承担方式以及我国目前的相关立法现状几方面进行阐述,并进一步提出立法建议,以保护公民的合法的财产权益。本文首先讨论了网络游戏虚拟财产属于财产的范畴,并进一步辨析出其应当属于《物权法》所保护的物。因此,网络游戏虚拟财产作为一种合法的财产应当受我国《侵权责任法》的保护,他人在侵犯网络游戏虚拟财产后应当承担侵权责任。此种侵权责任在主体、客体、救济方式上都存在着的特殊性,不同的侵权主体也有相应的侵权行为方式。而在侵权责任的归责原则的问题上,第三人的侵权责任应当适用过错责任原则,运营商的侵权责任则应当适用过错推定原则。在此基础之上,本文探讨了在第三人和网络游戏运营商构成共同侵权时二者所应承担的侵权责任的类型的不同。当运营商主观过错为“故意”时,运营商应当与第三人承担连带责任;当运营商只是违反了安全保障义务,主观过错为“过失”时,第三人与运营商应当承担按份责任。而在侵权责任的承担方式的问题上,返还财产以及恢复原状的方式应当占有特殊地位,在对被侵权人进行赔偿时,应当优先适用返还财产和恢复原状的方式,在无法适用以上两种方式时再使用赔偿损失的方式。本文最后探讨了我国目前的有关网络游戏虚拟财产立法的现状,并指出其存在的不完善之处,包括相关法律文件的效力较低、法律规定忽视了网络游戏虚拟财产的特殊性、规定存在滞后性等问题。在此基础上,本文提出了相应的完善网络游戏虚拟财产侵权责任的立法建议,首先应当通过司法解释的方式将网络游戏虚拟财产纳入到法律保护的范围之内,并具体规定侵权责任的归责原则、承担方式等内容;其次,国家应当建立网络游戏虚拟财产的价值评估标准。
[Abstract]:At present, the number of online game virtual property infringement cases in our country is increasing day by day, but the relevant laws and regulations are not perfect, and the protection of online game virtual property is also insufficient. This paper mainly discusses the tortious liability that the tortfeasor should bear after violating the legal virtual property of other people's online games. This paper will expound the basic theory of tort liability of virtual property of online game, the type of tort liability, the way of tort liability and the current legislation situation of our country, and put forward further legislative suggestions. To protect the lawful property rights and interests of citizens. This paper first discusses that the virtual property of online games belongs to the category of property, and further discriminates that it should belong to the protection of the property Law. Therefore, as a kind of legal property, the virtual property of online game should be protected by the tort liability law of our country, and others should bear the tort liability after infringing upon the virtual property of online game. This kind of tort liability has its particularity in subject, object and remedy. On the issue of liability principle of tort liability, the tort liability of the third party should be applied to the principle of fault liability, and the tort liability of operator should be applied to the principle of presumption of fault. On this basis, this paper discusses the different types of tort liability between the third party and the online game operator when they constitute joint tort. When the operator's subjective fault is "intentional", the operator should bear joint and several liability with the third party; when the operator only violates the obligation of safety protection and the subjective fault is "fault", the third party and the operator should bear the share responsibility. On the issue of the way to assume the tort liability, the return of property and the way of restitution should have a special status. In the compensation of the infringed person, the mode of returning the property and restoring the original state should be applied first. The method of compensation for loss shall be used when the above two methods cannot be applied. In the end, this paper discusses the current situation of the legislation on virtual property of online games in our country, and points out its imperfections, including the low effectiveness of relevant legal documents, and the neglect of the particularity of virtual property of online games by legal provisions. There are problems such as lag. On this basis, this paper puts forward the corresponding legislative suggestions to improve the tort liability of virtual property of online games. Firstly, the virtual property of online games should be brought into the scope of legal protection by means of judicial interpretation. It also specifies the liability principle of tort liability and the way to assume it. Secondly, the country should establish the value evaluation standard of virtual property of online games.
