我国民法典继承编特留份制度之重构

【摘要】：特留份制度与我国必留份制度本质相同,二者之间仅存在制度功能发挥程度和范围上的差异,故无需分别设计两种制度。我国必留份制度在立法上存在主体范围狭窄、必留份份额不确定及"双无人员"的认定缺乏统一标准等问题,导致该制度本源功能发挥不足,亦导致司法裁判"同案不同判"。因此,为适应社会对养老育幼的制度需求和统一司法裁判之实践需求,建议用特留份概念取代必留份概念,以重构我国统一的特留份制度。
[Abstract]:The system of special reservation is essentially the same as that of our country, and there are only differences in the extent and scope of the function of the two systems, so there is no need to design the two systems separately. In our country, there are some problems in legislation, such as the narrow scope of the subject, the uncertainty of the share of the compulsory share and the lack of uniform standard in the determination of "double no person", which leads to the insufficiency of the original function of the system and the different judgment of the judicial judgment. Therefore, in order to meet the needs of the society for the old-age care system and the practice of unified judicial decision, it is suggested that the concept of "special retention" be used instead of the concept of "must stay" in order to reconstruct the unified special retention system of our country.
