近代中国民法典编纂中的“习惯法”

【摘要】：在近代中国法律移植运动中,各种新型法律概念生成。"习惯法"一词正是1911年《大清民律草案》借鉴《瑞士民法典》的产物。在现代民法典编纂过程中,如何认识、界定、评价、吸纳与整合既有的本土习惯是一个重要课题。清末,"习惯法"作为法律渊源虽然在立法中确立,但由于缺乏实证化和司法化的机制,导致民商事习惯无法转化为确定的形式化法律条文,民商事习惯调查成果也被束之高阁。民国以降的主流法律理论深受德国思想影响,倾向于贬抑"习惯法"的作用。近代中国法律史上"习惯法"的命运,对当下中国的民法典编纂,仍然具有深刻的启示意义。
[Abstract]:In the modern Chinese legal transplant movement, various new legal concepts came into being. " The term "customary law" is the product of drawing lessons from the Swiss Civil Code in 1911. In the process of compiling the modern civil code, how to understand, define, evaluate, absorb and integrate the existing local customs is an important subject. At the end of Qing Dynasty, "customary law" was established as a legal source in legislation, but because of the lack of positivism and judicial mechanism, civil and commercial habits could not be transformed into definite formal legal provisions, and the results of civil and commercial custom investigation were also shelved. The mainstream legal theory of the Republic of China was deeply influenced by German thought and tended to degrade the role of "customary law". The fate of "customary law" in the history of modern Chinese law still has profound enlightening significance for the current compilation of Chinese civil code.
