论商标侵权判定中的商标性使用要件

【摘要】：“商标性使用”看似是一个新颖的词汇,实际上,我国商标法第四十八条就是对其本质性的规定。“商标性使用”在处理商标侵权纠纷中具有重要的地位。具体地说,其是判定商标侵权的前提条件,被控侵权人只有构成商标性使用,才有商标侵权的可能。该论断可以通过以下几个方面进行解释:第一,其以使用侵权为研究对象;第二,商标法具有整体性;第三,商标侵权的本质在于破坏特定关联;第四,“商标性使用”独立于“混淆可能性”。虽然,商标侵权案件的情况复杂多变,甚至有的案件存在极强的特殊性,但是我们仍可以归纳出一些判断“商标性使用”的标准。在判断商标侵权中的“商标性使用”时,我们应当采用来源识别的属性标准、商业标识的范围标准、来源识别可能性的程度标准。另外,在判断“商标性使用”时,还应当结合相关公众的认知水平,并考虑被告人的商标使用方式。
[Abstract]:Trademark use seems to be a novel term. In fact, Article 48 of Trademark Law of our country stipulates its essence. Trademark use plays an important role in dealing with trademark infringement disputes. Specifically, it is a prerequisite for judging trademark infringement, and the alleged infringer can only constitute trademark use. The conclusion can be explained in the following aspects: first, it takes the use of tort as the research object; second, the trademark law has integrity; third, the essence of trademark infringement is to destroy the specific connection; fourth, Trademark use is independent of confusion possibility. Although the situation of trademark infringement cases is complex and changeable, and even some cases have strong particularity, we can still conclude some criteria for judging "trademark use". In judging the trademark use in trademark infringement, we should adopt the attribute standard of source identification, the scope standard of commercial identification, and the degree standard of possibility of source identification. In addition, when judging trademark use, we should consider the related public cognition level and the defendant's trademark usage.
