论居住权权利框架体系的构建

【摘要】：居住权作为一项集合物权、人权、民生权等多项权利基因的综合性权利,乃是法律保障居住权益和实现房屋效用价值的重要权利体现,其具体权利的规范性设置是明确居住权纠纷案件适用标准、解决居住权纠纷的基本要求。鉴于其权利的可诉性与规范的可操作性,当在明确居住权的物权属性基础上以居住权的法理基础和司法裁判为考量依据,规定居住权为一种法定权利,构建以《物权法》为核心的居住权权利框架体系,从而维护权利人的居住利益,实现居住权的法律保护。
[Abstract]:As a collective real right, human rights, people's livelihood rights and other rights gene comprehensive rights, is the legal protection of housing rights and interests and the realization of housing utility value of an important right to reflect. The normative setting of its specific right is the basic requirement of defining the applicable standard of the dispute case of residence right and resolving the dispute of residence right. In view of the justiciability of the right and the operability of the norm, the right of residence is defined as a legal right on the basis of the legal basis and the judicial decision of the right of residence, on the basis of defining the property attribute of the right of residence. In order to safeguard the living interests of the obligee and realize the legal protection of the right of residence, the frame system of the right of residence is constructed with the real right law as the core.
