图书馆馆藏资源数字化过程中孤儿作品的利用问题——对合理勤勉检索义务的探究

【摘要】：孤儿作品作为图书馆馆藏资源中十分重要的部分,其数字化利用将对图书馆的数字化建设产生重大影响。为了便利孤儿作品的数字化利用,各国大都通过立法的形式建立了孤儿作品利用制度,我国著作权法第三次修改草案也增加了相应条款,拟解决对孤儿作品利用的需求和无法授权之间的矛盾。但根据各国的通行做法和著作权法修改草案的规定,图书馆若想使用孤儿作品,其前提是进行了合理勤勉的检索,且并未找到可联系的权利人。而对于合理勤勉检索的标准要求的不同,将决定图书馆究竟能否使用作品。合理勤勉检索虽看似是使用人的一项义务,但是否具有完善的信息检索平台也十分关键,而这也是我国在建立孤儿作品制度时必须予以完善的重要方面。
[Abstract]:As an important part of library collection, the digitization of orphan works will have a great impact on the construction of library digitalization. In order to facilitate the digital utilization of orphans' works, most countries have established the system of using orphan works by way of legislation, and the third revised draft of the copyright Law of our country has also added corresponding provisions. It is intended to resolve the contradiction between the need for the use of orphan works and the inability to authorize them. However, according to the common practice of various countries and the provisions of the revised draft of copyright Law, if the library wants to use the orphan works, the premise is that it has carried out a reasonable and diligent search, and has not found the right owner who can be contacted. The difference in the standard of reasonable and diligent retrieval will determine whether the library can use the works. Although reasonable and diligent retrieval seems to be an obligation of the user, it is also very important to have a perfect information retrieval platform, which is also an important aspect that must be perfected when establishing the system of orphans' works in our country.
