论农民住房有限抵押

【摘要】:农民住房抵押以有限抵押为基本理念,但现有制度设计存在"房地一体"与"房地分离"的路径分歧和配套制度缺失或法理悖论等问题。这些问题的产生与有限抵押的设计理据存在偏差不无关系。因此,在重述农民住房有限抵押的正当理据不是宅基地使用权的身份性、无偿性或福利性,而应是保证农户基本住房权利、兼顾集体与农户对宅基地使用权增值收益分享的基础上,本文对试点地区与非试点地区农民住房有限抵押进行类型化制度重构。在试点地区,宜坚持"房地一体"抵押、合理取舍地方实践之有限抵押的设计,并完善宅基地使用权的主体限定、增值收益分配以及非本集体成员受让地权的登记、期限限制等配套制度;在非试点地区,暂时可按"房地分离"的思路,创新法定租赁权,但应从租金归属、担保客体、出租人等方面对相关建议进行改造。
[Abstract]:Farmers' housing mortgage is based on the concept of limited mortgage, but there are some problems in the design of the present system, such as "integration of premises" and "separation of premises", lack of supporting system or paradox of legal theory, etc. These problems have something to do with the design motivation of finite mortgage. Therefore, the legitimate justification for restating the limited mortgage of farmers' housing is not the identity, gratuitous or welfare nature of the right to use the homestead, but the guarantee of the farmers' basic housing rights. Based on the sharing of value-added income between the collective and the farmers on the right to use the homestead, this paper reconstructs the typological system of the limited mortgage of the farmers' housing in the pilot area and the non-pilot area. In the pilot area, we should adhere to the "premises as a whole" mortgage, reasonably choose and choose the design of the limited mortgage of local practice, and perfect the subject limit of the right to use the homestead, the distribution of value-added income and the registration of the land rights assigned to the non-members of the collective. In the non-pilot area, we can innovate the legal lease right according to the idea of "separation of premises", but we should reform the relevant suggestions from the aspects of rent ownership, guarantee object, lessor and so on.
