网络购物中消费者权益救济研究

【摘要】:随着科学技术的不断发展和市场竞争的加剧,我国网络购物进入到了一个更为激烈的竞争环境下。而目前我国关于在网络购物中消费者权益救济的问题与一些发达国家相比,普遍存在着成本高、效率低、救济体系不完善等问题。本论文从网络购物与消费者权益救济的内涵出发,系统阐述了网络购物中消费者权益救济的现状、受侵害的表现等。接着研究了国外关于网络购物中消费者权益救济的做法和启示,通过对美国、日本、欧盟国家消费者权益救济的做法中提炼出适合我国的发展建议。最后研究了我国在网络购物中消费者权益救济的对策,从拓宽救济途径、完善举证责任、规范信用评价体系等六个方面对我国在网络购物中的缺陷问题进行系统的深入,以期改善和完备消费者在网购方面的需求。本论文提出的内容对完善我国网络购物中消费者权益救济的问题具有一定的参考价值。
[Abstract]:With the development of science and technology and the aggravation of market competition, China's network shopping has entered a more intense competitive environment. At present, compared with some developed countries, there are many problems in our country, such as high cost, low efficiency, imperfect relief system and so on. Starting from the connotation of online shopping and consumer's rights and interests relief, this paper systematically expounds the current situation of consumer's rights and interests relief in network shopping, the performance of infringement, etc. Then, the author studies the methods and enlightenment of consumers' rights and interests relief in online shopping abroad, and extracts the development suggestions suitable for our country through the methods of consumers' rights and interests relief to the United States, Japan and European Union countries. Finally, the author studies the countermeasures of consumers' rights and interests relief in online shopping in China, and systematically deepens the defects in online shopping from six aspects, such as broadening the relief channels, perfecting the burden of proof, standardizing the credit evaluation system, and so on. With a view to improving and complete consumer demand for online shopping. The content of this paper has certain reference value to consummate the problem of consumer's rights and interests relief in our country's network shopping.
