我国著作权延伸性集体管理制度研究——兼评我国《著作权法》修改草案

【摘要】：在本次《著作权法》第三次修订中,我国创设了著作权延伸性集体管理制度,引发了不少争议。著作权延伸性集体管理制度能够降低著作权许可的交易成本,并有利于维持作品传播与著作权保护之间的平衡,具有制度的正当性。我国具有实施著作权延伸性集体管理的现实要求,并已经做出了有意义的实践尝试。该制度在性质上属于"权利限制"制度,应当受"三步检测法"的规制。我国立法应当完善认定著作权集体管理组织"代表性"的标准,维护非会员著作权人的合法权利,并明确著作权延伸性集体管理的适用范围,消除目前存在的使用者重复付费的可能性,以实现著作权人和作品使用人之间的利益平衡。
[Abstract]:In the third revision of the copyright Law, our country created the extended collective management system of copyright, which caused a lot of controversy. The extended collective management system of copyright can reduce the transaction cost of copyright license and maintain the balance between the spread of works and the protection of copyright. Our country has the realistic request of implementing the extended collective management of copyright, and has made a meaningful practice attempt. This system belongs to "right restriction" system in nature and should be regulated by "three-step detection law". The legislation of our country should perfect the standard of determining the "representativeness" of copyright collective management organizations, safeguard the legal rights of non-member copyright owners, and clarify the scope of application of the extended collective management of copyright. Eliminate the existing possibility of user repayments in order to achieve a balance of interests between copyright owners and users of works.
