论网络环境下消费者个人信息的法律保护

【摘要】:21世纪,是以信息技术以及信息产业为支柱的信息社会,计算机技术的飞速发展,网络的日益普及,都使得互联网深入到了人们日常生活的方方面面,科技就像是硬币的两面,有好也有坏,它在使我们的生活更加便捷的同时,带来的问题也日益凸显。在网络环境下消费者个人信息频频遭受侵害便是其中之一。网络消费者的个人信息屡遭侵害,合法权益得不到应有的保护,这不仅损害了消费者自身的合法权益,更加不利于整个社会的健康发展。 在信息时代,,消费者个人信息可以说是促进经济发展的必不可少的资源。例如商家为了获取经济利益,通过分析相关的消费者个人信息从而掌握相关消费者的消费倾向,从而进行针对性的宣传与促销。正是看到了个人信息的商业价值,一些不法分子非法的窃取、买卖消费者的个人信息,从而损害了消费者的合法权益。在电子商务蓬勃发展的今天,完善对消费者个人信息的法律保护,不仅是保护公民合法权益的需要,更是实现网络环境下经济健康发展的需要。本文在借鉴域外经验的基础上,结合我国国情,提出了适当的建议。 除去引言和结语,全文一共分为三部分: 第一部分,从个人信息的特点入手,介绍了网络环境下消费者个人信息的特征及价值,并具体阐述了在网络环境下消费者对其个人信息享有哪些权利,以及保护消费者个人信息的必要性,指出了我国消费者个人信息屡遭侵权的现状。 第二部分,列举了美国、欧盟以及日本的消费者个人信息法律保护模式,并对其进行了分析,在此基础上提出了域外有关网络环境下消费者个人信息权保护对我国的启示。 第三部分,作为本文的重点,在审视我国现有的有关网络环境下消费者个人信息保护立法的基础上,论述了我国法律在保护消费者个人信息方面存在的问题,并对如何完善我国消费者个人信息的法律保护提出了相关的建议
[Abstract]:In the 21st century, information technology and information industry are the mainstay of the information society. With the rapid development of computer technology and the increasing popularity of the network, the Internet has penetrated into every aspect of people's daily life. Science and technology are like two sides of a coin. There are good and bad, it makes our life more convenient, but also brings more and more serious problems. One of them is the frequent infringement of consumer personal information under the network environment. The personal information of online consumers is violated repeatedly, and their legitimate rights and interests are not protected, which not only damages the legitimate rights and interests of consumers themselves, but also is not conducive to the healthy development of the whole society. In the information age, consumer personal information can be said to be an indispensable resource to promote economic development. For example, in order to obtain economic benefits, merchants can grasp the consumption tendency of relevant consumers by analyzing relevant consumer personal information, so as to carry out targeted publicity and promotion. It is to see the commercial value of personal information, some illegal elements to steal, buy and sell personal information of consumers, thereby damaging the legitimate rights and interests of consumers. With the rapid development of electronic commerce, it is not only the need to protect citizens' legitimate rights and interests, but also the need to realize the healthy development of economy under the network environment. Based on the experience of foreign countries and the situation of our country, this paper puts forward some appropriate suggestions. Apart from the introduction and conclusion, the full text is divided into three parts: the first part, from the characteristics of personal information, introduced the characteristics and value of consumer personal information under the network environment. It also expounds the rights of consumers to their personal information under the network environment and the necessity of protecting consumer's personal information, and points out the current situation that consumers' personal information is frequently infringed in our country. The second part lists the legal protection models of consumer's personal information in America, European Union and Japan, and analyzes them. On this basis, it puts forward the enlightenment of consumer's personal information right protection to our country under the overseas network environment. The third part, as the focal point of this paper, on the basis of examining the existing legislation of consumer personal information protection under the network environment in our country, discusses the problems existing in the protection of consumer personal information in the law of our country. Some suggestions are put forward on how to perfect the legal protection of consumer personal information in China.
