论商标俗称保护的公众使用规则

【摘要】:近十年,我国司法实践陆续出现“”了一些商标俗称的侵权纠纷案件。这一系列的案件中,原商标持有人都未曾对商标俗称予以在先的主动使用,所以当他们请求法院保护其在先使用权时,法院的判决几乎无一支持。从我国现有的案件来看,法院几乎不支持原商标权利人对公众使用在先的商标俗称享有权利,表现为法院判决支持第三人对商标俗称进行注册使用。法院认为公众对商标“”俗称的在先使用并不是原商标持有人自己的使用,不符合我国商标法对商标使用行“”为的规定,因此原商标持有人称自己在先使用于法无据,不予支持。但是早在1919年,美国就曾发生过类似的案例,经过近百年的案例补充,公众使用规则在美国得以发展,并在1942年Coca-Cola Co.v.Busch案中承认公众使用规则属于商标法原则,原商标持有人对商标俗称享有权利。这个判决结果既保护了原商标持有人的利益,也避免了消费者混淆不同商品/“”“服务来源,兼顾了保护消费者原则和在先使用原则二”者“的平衡。我国司法实践完全否认公众使用规则在某程度上造成了保护”消费者原则和“”在先使用原则的严重失衡,如何在我国商标俗称案件审理中适当引入公众使用规则?本文将就这一问题进行深入的探讨。本文将分四个部分对商标俗称保护中公众使用规则展开论述。第一部分首先对商标俗称的概念以及保护的必要性进行理论分析。这主要是从商标权客体理论和公共利益理论两方面进行。第二部分首先对公众使用规则进行界定,随后详细分析三个著名判例,深入了解公众使用规则在美国的发展历程,最后对公众使用规则的实质进行深入的分析。第三部分首先从我国目前的立法实践对公众使用规则规定不明确说起;其次从我国的数个著名商标俗称案例着手,分析我国司法界目前对商标俗称公众使用规则持否定态度;最后,分析我国理论界对公众使用规则持有不同的观点。第四部分从理论上分析我国应该在审理商标俗称案件中适当承认公众使用规则,并且对公众使用规则进行重新构建。
[Abstract]:In recent ten years, the judicial practice of our country has appeared some trademark infringement disputes. In this series of cases, the original trademark holders did not take the initiative to use the trademark, so when they asked the court to protect their prior right of use, the court's judgment was hardly supported. Judging from the existing cases in our country, the court almost does not support the original trademark owner to enjoy the right to the trademark which was used by the public before, which is manifested by the court judgment supporting the third party to register the trademark common name. The court held that the public's prior use of the trademark "common name" was not the original trademark holder's own use, and did not meet the requirements of the trademark law of our country for the use of the trademark. Therefore, the original trademark holder said that he had used the trademark in the first place without any basis in the law. No support. But as early as 1919, similar cases occurred in the United States. After nearly a hundred years of supplementation, the rules of public use were developed in the United States, and in the 1942 Coca-Cola Co.v.Busch case, the rules of public use were recognized as principles of trademark law. The holder of the original trademark shall have the right to the common name of the trademark. This decision not only protects the interests of the original trademark holder, but also prevents consumers from confusing different sources of goods / "services", and balances the principle of consumer protection with that of the "person" who first uses principle 2. The judicial practice of our country completely denies that the rules of public use have caused the serious imbalance between the principle of consumer protection and the principle of prior use to some extent. How to introduce the rules of public use in the trial of trademark common name cases in our country? This article will carry on the thorough discussion to this question. This article will be divided into four parts to discuss the rules of public use in trademark protection. The first part analyzes the concept of trademark and the necessity of protection. This is mainly from the trademark right object theory and public interest theory two aspects. The second part defines the rules of public use, then analyzes three famous precedents in detail, deeply understand the development of the rules of public use in the United States, and finally makes a deep analysis of the essence of the rules of public use. The third part starts from the current legislative practice of our country to the public use rule stipulation is unclear; secondly from our country's several famous trademark common name cases, analyzes our country judicial circles at present to the trademark common name public use rule holds the negative attitude; Finally, the author analyzes the different views of Chinese theorists on the rules of public use. The fourth part theoretically analyzes that our country should recognize the rules of public use in the trial of trademark common name cases and reconstruct the rules of public use.
