试论《民法总则》对人格尊严的保护

【摘要】：《民法总则》第109条对人格尊严的保护做出规定,彰显了21世纪民法的时代精神,强化了人文关怀,有利于进一步提升我国公民人格权的法律保护水平。该条关于人格尊严保护的规定具有一般人格权的规范属性,体现了人格尊严平等保护的价值理念,具有承接和实施宪法的功能,明确了人格权保护的价值基础。该条也为未来民法典编纂指明了方向。为了进一步强化对人格尊严的保护,应当加强人格权立法,在民法典中构建独立成编的人格权法。
[Abstract]:Article 109 of the General principles of Civil Law provides for the protection of human dignity, which demonstrates the spirit of the times of the civil law in the 21st century, strengthens the humanistic care, and is conducive to the further improvement of the level of legal protection of the personality rights of citizens in our country. The stipulation on the protection of human dignity has the normative attribute of general personality right, embodies the value idea of equal protection of human dignity, has the function of carrying on and carrying out the constitution, and clarifies the value foundation of the protection of personality right. This article also points out the direction for the future civil code compilation. In order to further strengthen the protection of human dignity, we should strengthen the legislation of personality right and construct an independent personality right law in civil code.
