论电子商务立法的理念、框架和重点内容
[Abstract]:China is promoting the legislation of e-commerce law. In the process of E-commerce legislation, we should not only respect the current legal rules and logic system, but also pay attention to the characteristics of e-commerce itself and adhere to the problem-oriented. On the basis of existing laws, appropriate additions, amendments and improvements can be made, if necessary, to formulate separate laws and regulations. In view of the difficult problems in the development of electronic commerce, emphasis should be placed on strengthening the legislative work related to the judgment of the subject of electronic transactions and the judgement of the contracting ability, the regulation of the conduct of electronic transactions, the certification of electronic transactions and the online dispute resolution mechanism.
