流媒体技术对我国广播组织权制度的挑战

【摘要】：流媒体技术的产生促使数字化信息可以跨越传统传播媒介,实现如广播电视、电话、因特网等三者之间的无障碍流转。而这种无障碍信息流转的实现带来了网络广播的无限风光,受众可以即点即看。但是由于我国现行《著作权法》的立法缺陷,造成转播权、复制录制权、信息网络传播权都无法控制网络广播行为,迫切需要立法修订对此加以弥补。因此,在目前《著作权法》第三次修订征求意见之际,广播组织权制度改革遵循"技术中立"原则应是很好的选择。
[Abstract]:The emergence of streaming media technology makes digital information cross the traditional media and realize the barrier-free circulation among radio and television, telephone, Internet and so on. The realization of this kind of barrier-free information circulation brings the infinite scenery of network broadcasting, and the audience can look at it immediately. However, due to the legislative defects of the current copyright Law of our country, the rights of broadcasting, reproduction and recording, and the right of information network dissemination can not control the behavior of network broadcasting, so it is urgent to amend the legislation to make up for this. Therefore, when the copyright Law is revised for the third time, it should be a good choice for the reform of broadcasting organization right system to follow the principle of "technology neutrality".
