集体土地之上的“小产权房”法律问题研究

【摘要】: “小产权房”是社会约定俗成的概念,之后在国务院办公厅、住房城乡建设部发布的文件中也被提及,但是在学理或者法律上还没有形成一个规范的解释,而且涉及的法律问题纷繁复杂,其中不仅有立法相对滞后以及法律适用上的冲突产生的问题,还有现实中利益分配格局情况复杂、诸多违法现象产生的问题。问题的原点是要对“小产权房”基本问题的清晰厘定。本文除引言和结论以外,分为四个部分。 第一部分是对“小产权房”的基本问题进行说明,以期得到对其整体上的认识。首先对“小产权房”的概念进行界定,阐明本文所要论述的对象。然后概括小产权房的特点,对其现阶段的积极意义和消极影响进行了阐述。 第二部分从经济原因和制度原因两个方面分析“小产权房”产生的根源。在经济原因方面,城市住房、建设用地供需不平衡、土地出让成本增加和土地增值收入分配不合理共同构成了“小产权房”产生的内驱力;在法律原因方面,二元土地法律制度致使土地与之上的建筑物或是其他地上附着物的权属的不一致,阻碍了土地与房屋所有者行使所有权的全部权能,是产生“小产权房”的根本原因。 第三部分在现阶段“小产权房”还不具备适法性的情境下,力图阐明其所涉的民事法律问题:登记、抵押等物权问题:合同效力问题;继承、遗赠和赠与问题以及监督管理等问题。 第四部分是分析问题、解决问题的部分。本文结合党的土地政策、民商法的基本原理和现行法律法规,论证了“小产权房”问题解决的理论基础,并在此基础上进行分析,强调了对“小产权房”不能采取单一的解决方式即宣布为非法予以拆除,提出了对农村集体土地中不同性质的土地要进行分类细化,对于建设其上的“小产权房”采取“区别对待”的法律解决方案,在考虑符合社会实际情况因子,整合现有法律、法规的合理性规定后,阐述了对其修改的立法思考,以期在减小立法成本的同时,实现法律体系的统一和稳定过渡。
[Abstract]:"small property right" is the concept of social convention, then in the general office of the State Council, the Ministry of Housing Urban-Rural Construction issued in the document is also mentioned, but in the academic or legal has not formed a normative interpretation. And the legal issues involved are complicated, not only the relative lag of legislation and the conflict of the application of the law, but also the complicated situation of the distribution pattern of interests in reality. The origin of the problem is to clearly determine the basic problem of "small property right". Besides the introduction and conclusion, this paper is divided into four parts. The first part is to explain the basic problems of "small property house", in order to get its overall understanding. First of all, the concept of "small property right house" is defined. This paper expounds the object of this article, and then generalizes the characteristics of the small property right house, and expounds its positive significance and negative influence at the present stage. The second part analyzes the causes of "small property right" from two aspects of economic reasons and institutional reasons. In economic reasons, urban housing, construction land supply and demand imbalance. The increase of land transfer cost and the unreasonable distribution of land value-added income constitute the driving force of "small property right house". In terms of legal reasons, the dual land legal system leads to the inconsistency between the ownership of land and buildings or other aboveground appendages, and hinders the full power of the owners of land and houses to exercise their ownership rights. It is the root cause that produces "small property right room". The third part tries to expound the civil legal problems involved in the "small property right" in the current situation that "small property right" does not have proper law: registration, mortgage and other real right issues: contract validity; Inheritance, bequeath and gift issues and supervision and management issues. The 4th part is the part of analyzing and solving the problem. This paper demonstrates the theoretical basis of solving the problem of "small property right" in combination with the Party's land policy, the basic principles of civil and commercial law and the current laws and regulations. On the basis of the analysis, the author emphasizes that the "small property right" can not be solved by a single way, that is, it is declared to be illegal to demolish, and proposes that the land of different nature in the rural collective land should be classified and refined. For the construction of its "small property right" to take "differential treatment" of the legal solution, in line with the social reality factor, the integration of existing laws and regulations of the rationality of the provisions. This paper expounds the legislative thinking on its revision in order to realize the unification and stable transition of the legal system while reducing the cost of legislation.
