菲律宾海员法研究

【摘要】:随着经济全球化格局的日趋形成,国际间各种形式的交换越来越频繁。特别是20世纪80年代以来,国际航运市场发生了重大变化,其中,航运人才供需关系的变化尤为突出。由于经济的发展,使人们的价值观和择业观发生了变化,发达国家选择海员作为职业的人数锐减。在这种背景下,国际海员劳务市场为发展中国家进行国际海员劳务输出提供了一个广阔的发展空间。菲律宾利用其海员英语水平较高的优势,并辅之以完备的法律制度及健全的管理体制,使菲律宾成为世界上最大的海员输出国。 我国劳动力资源丰富,海员队伍庞大,航海教育的迅速发展使我国航运业在国际航运市场上占据了举足轻重的地位,并且我国的海员劳务输出也被列为世界海事组织认可的白名单。但是,我国目前还没有颁布《海员法》,与海员相关的规定散见于《海商法》及其他单行法规。可见,海员立法存在大量法律漏洞,在海员外派管理体制、权利保障等方面也存在大量问题亟待解决。 针对上述问题,本文主要采用实证法、比较法和历史分析法的方法,对菲律宾海员外派的相关法律制度、管理体制及权利保障等方面进行分析、探讨,并与我国相关法律政策、管理体制进行比较分析,发现并提出问题,寻找问题的根源和结症;试图通过上述比较分析,在海员相关立法、外派海员管理体制、权利和社会保障等方面提出既适合我国国情又符合国际惯例的立法建议和改进措施,,保证我国海员劳务市场健康有序的发展,进一步发掘我国海员外派业务的潜力。
[Abstract]:With the formation of economic globalization, various forms of international exchanges are becoming more and more frequent, especially since 1980s, the international shipping market has undergone major changes, among which. The change of supply and demand of shipping talents is especially prominent. Because of the development of economy, people's values and job outlook have changed, and the number of developed countries choosing seafarers as their occupation has decreased sharply. The international seafarers' labour market provides a broad development space for developing countries to export international seafarers' services. The Philippines takes advantage of its seafarers' high standard of English. Supported by a complete legal system and sound management system, the Philippines became the largest exporter of seafarers in the world. Our country is rich in labor resources, the seafarer troop is huge, the rapid development of navigation education makes the shipping industry of our country occupy the pivotal position in the international shipping market. Moreover, the export of seafarers' labor services in our country is also listed as a white list approved by the World Maritime Organization. However, China has not promulgated the Seafarers Law at present. The regulations related to seafarers are scattered in the Maritime Law and other laws and regulations. It can be seen that there are a lot of legal loopholes in seafarers' legislation, and there are many problems to be solved in the management system of seafarers' assignment and the guarantee of their rights and so on. In view of the above problems, this paper mainly adopts the methods of positive, comparative and historical analysis to analyze and discuss the relevant legal system, management system and right guarantee of Philippine seafarers' assignment. And with our country's related laws and policies, management system comparative analysis, find and put forward the problem, to find the root cause of the problem and symptoms; Through the above comparative analysis, the author tries to put forward legislative suggestions and improvement measures in the aspects of seafarers' relevant legislation, management system, rights and social security of expatriate seafarers, which are both suitable for China's national conditions and in line with international practice. To ensure the healthy and orderly development of China's seafarers' labor market, and to further explore the potential of Chinese seafarers' overseas service.
