游艇俱乐部民事法律责任研究

【摘要】：改革开放以来,随着我国经济的持续推进和人们生活水平的提高,游艇产业也得以蓬勃发展并在国民经济中占具愈发重要的地位。这其中游艇俱乐部在整个产业中扮演着关键角色,游艇俱乐部通过会员制的经营方式,由会员缴纳一定数量的会费,向他们提供游艇销售、游艇租赁、游艇管理以及休闲、运动等相关配套服务。根据中国交通运输协会邮轮游艇分会(CCYIA)的统计数据,截至2012年12月,我国已建立近200所游艇俱乐部,其中以长三角和珠三角地区为主。但是,有关游艇俱乐部民事主体身份以及民事法律责任的立法却相对单一。虽然专门调整游艇关系的规定散见于《关于加强游艇管理的通知》、《游艇安全管理规定》等行政法规、部门规章以及《海南省游艇管理试行办法》、《浙江海事局游艇安全监督管理实施细则》等地方性法规中。本文根据现阶段以及游艇俱乐部的发展态势分析,对游艇俱乐部的民事法律责任进行初步研究。将从以下四个部分予以论述：第一部分为游艇俱乐部概述。通过收集大量的资料对游艇俱乐部的概念特征、产生发展、影响界定法律地位因素的整理,并对游艇与《海商法》意义下的“船舶”的进行界定,并证明对游艇俱乐部民事法律责任进行研究的必要性与重要性。第二部分的内容是游艇俱乐部民事法律责任概述。首先从法理学上的民事法律责任概念进行归纳,然后整理了我国关于游艇俱乐部民事法律责任的有关法律规定,并着重对游艇俱乐部的主体身份界定和权利义务关系进行了分析,理清了研究游艇俱乐部民事法律责任问题的思路。第三部分是游艇俱乐部在具体民事活动中的民事法律责任。该部分从游艇俱乐部与会员之间的法律关系以及游艇俱乐部与第三人之间的法律关系入手,重点对游艇俱乐部的侵权责任和违约责任作了梳理,具体分析了会员卡、船舶碰撞以及油污污染等问题,为以后的理论研究或司法实践应该可以提供些许帮助。第四部分为针对现阶段游艇俱乐部民事责任存在的一些问题提出的有利于游艇俱乐部民事法律责任规范的相关建议。

In the local regulations such as the detailed rules for the Supervision and Administration of Yacht Safety of Zhejiang Maritime Administration, this paper analyzes the development situation of the yacht club and the present stage. A preliminary study of the civil liability of yacht clubs will be carried out in the following four parts: The first part is an overview of yacht club. Through collecting a large amount of information, the concept of yacht club characteristics, development, influence the definition of legal status factors collation. It also defines "ship" in the sense of yacht and maritime law, and proves the necessity and importance of studying the civil liability of yacht club. The second part of the content is the yacht club civil liability overview. First of all, from the jurisprudence of the concept of civil legal liability to sum up. Then the author collates the relevant legal provisions on the civil legal liability of yacht club, and analyzes the relationship between the subject identity and the rights and obligations of the yacht club. It clarifies the idea of studying the civil liability of yacht club. The third part is the civil liability of yacht club in specific civil activities. This part starts with the legal relationship between yacht club and member and the legal relationship between yacht club and third party. Focus on the yacht club liability for tort and breach of contract liability combed, the specific analysis of membership cards, ship collision and oil pollution and other issues. For the future theoretical research or judicial practice should be able to provide some help. In the 4th part, the author puts forward some suggestions in favor of the regulation of the civil liability of the yacht club in view of the problems existing in the civil liability of the yacht club at the present stage.
