【摘要】:国际货物多式联运是当今货物运输的最主要方式。本文的研究对象正是国际货物多式联运法律制度中的核心内容——多式联运经营人责任制度。本文的基本框架如下: 第一章是对国际货物多式联运的概述,共分两节进行评述。在第一节分析了多式联运和多式联运经营人的定义和特征,第二节介绍了多式联运经营人责任制度的基本内容,包括责任形式、责任基础、责任期间和责任限额等。 第二章对上世纪通过的三部规范多式联运的国际公约和规则进行了比较,包括1975年《国际商会多式联运单据统一规则》,1980年《联合国国际货物多式联运公约》以及1992年《贸发会议/国际商会多式联运单据规则》。首先,该章第一节和第二节对这三部国际文件中的多式联运经营人责任制度的规定分别进行了介绍,进而第三节以图表和具体的分析对三部文件的相关内容加以比较和评述。 第三章专门为本世纪首个重要国际货物多式联运法律文件《联合国全程或部分海上运输合同公约》(又名鹿特丹规则)而设,共分四节,以较大篇幅评析了该公约中的承运人责任制度,着重分析了该公约的创新之处,特别对其该公约中责任基础的规定进行了详细阐述。 第四章是对我国多式联运经营人责任制度的评析和建议。第一节分析了我国《海商法》和《合同法》中有关多式联运经营人的责任形式、责任基础、责任期间、责任限额的规定,并总结了我国多式联运立法的弊病。第二节是在结合我国国情现实和前三章的论述的基础上提出了完善我国多式联运经营人立法的努力方向和具体建议。
[Abstract]:International multimodal transport of goods is the most important way to transport goods today. The object of this paper is the core content of the legal system of international multimodal transport of goods-the liability system of multimodal transport operators. The basic framework of this paper. As follows:. Chapter one is an overview of international multimodal transport of goods, which is divided into two sections. In the first section, the definition and characteristics of multimodal transport and multimodal transport operators are analyzed. The second section introduces the basic contents of multimodal transport operator liability system, including liability form, liability basis, liability period and liability limit. Chapter II compares the three international conventions and rules governing multimodal transport adopted in 0th century including the International Chamber of Commerce rules for the Harmonization of documents on Multimodal Transport of 1975. United Nations Convention on International Multimodal Transport of goods of 1980 and the UNCTAD / ICC Code of Multimodal Transport documents of 1992. First. Section I and II of this chapter respectively introduce the provisions of the liability regime for multimodal transport operators in the three international documents. Then the third section compares and comments the contents of the three documents with charts and concrete analysis. Chapter III is devoted to the first important legal document of this century on international multimodal transport of goods, the United Nations Convention on contracts for the Carriage of goods wholly or partly by Sea (also known as the Rotterdam rules), which is divided into four sections. In this paper, the carrier liability system in the Convention is reviewed, and the innovations of the Convention are emphatically analyzed, especially the provisions of the liability basis in the Convention are elaborated in detail. Chapter 4th is the analysis and suggestion of the liability system of multimodal transport operators in China. The first section analyzes the form and basis of liability of multimodal transport operators in Maritime Law and contract Law of China. The limitation of liability during the period of responsibility. The second section is based on the reality of our country's national conditions and the exposition of the first three chapters, and puts forward the direction and concrete suggestions to perfect the legislation of the multimodal transport operator in our country.
