论船舶优先权的行使

【摘要】:船舶优先权作为海商法一项古老的制度在促进航运业发展过程中发挥了重要 作用。世界各航运国家关于船舶优先权的法律规定日益完善,理论研究也十分丰 富,但是实践中在具体行使船舶优先权时却存在很多问题,因此本文侧重于从实 体和程序两个角度对船舶优先权行使的若干问题进行研究,希望能对船舶优先权 更好地发挥作用做出一点贡献。本文首先分析了船舶优先权行使的概念、特征、 条件及模式等问题,从而在理论上明确了船舶优先权行使的基本内容,为后文的 进一步研究奠定基础。世界两大主要法系——英美法系和大陆法系国家都有关于 船舶优先权的规定,但船舶优先权行使的诉讼程序有很大不同,本文对两者进行 了研究。船舶优先权的行使具有实体性,各国立法对船舶优先权行使的权利主体、 义务主体及客体都有规定,但这些规定并不能解决实践中复杂的问题。本文结合 实践中常见的问题对权利主体、义务主体及客体进行了分析研究,希望能有利于 实践中问题的解决。扣船与船舶优先权的行使具有十分密切的联系,本文比较分 析了扣船与船舶优先权行使的关系,并研究了多次扣船、“活扣”等情况下优先权 的行使。在研究过程中,本文参照国外立法及有关国际公约,对我国船舶优先权 行使立法规定存在的某些问题提出了完善建议。 实践是复杂的,问题是多样的,本文主要从以上四个方面对船舶优先权的行 使进行了研究,希望能对实践中船舶优先权行使过程中问题的解决有所益处。
[Abstract]:Maritime lien, as an ancient system of maritime law, plays an important role in promoting the development of shipping industry. The legal provisions on maritime liens of the world shipping countries are becoming more and more perfect, and the theoretical research is also very abundant. This paper analyzes the relationship between arrest of ship and the exercise of maritime lien, and studies the priority in the case of multiple arrest of ship and "live buckling". In the course of the study, this paper, referring to the foreign legislation and relevant international conventions, gives a reference to the maritime liens of our country. Some problems existing in the exercise of legislative provisions are put forward. The practice is complex, the problem is diverse, this article mainly from the above four aspects to the maritime lien line. It is hoped that it will be helpful to solve the problems in the process of maritime lien in practice.
