权利外观理论下的票据抗辩

【摘要】： 权利外观理论是商法的基本理论之一,它是德国私法学者在二十世纪初创立的,虽然我国学者对权利外观理论的研究较晚,但是这并不影响其在票据法领域的重要性,因为权利外观理论的宗旨在于维护交易安全,这无疑与票据法的立法理念相统一。本论文从票据抗辩分类体系的缺陷入手,以权利外观理论重新对票据抗辩的分类体系进行构建,即将票据抗辩分为：对物的抗辩、对人的抗辩和有效性抗辩,拟用权利外观理论对票据抗辩重新进行解释,以达到完善票据抗辩制度的目的。
[Abstract]:The right appearance theory is one of the basic theory of commercial law, it is the creation of German private law scholars at the beginning of twentieth Century, although the appearance of Chinese scholars on the rights theory of late, but this does not affect its importance in the field of law of negotiable instruments, because the right appearance theory aims to maintain the security of transactions, it is with the legislation of bills the idea of unity. This paper from the paper defect classification system defenses start to look right again the theory of bill plea classification system for construction, the defense is divided into: the matter of defense, the defense and effectiveness of defense, intends to use the right appearance theory of negotiable re interpretation, in order to achieve improve the system of negotiable instruments.
