市场信用的经济法保障

【摘要】： 市场经济是信用经济,市场信用是重要的社会资本。本文从法学视角对市场信用进行定义,探讨了市场信用机制,揭示了法律是现代社会市场信用保障的主要手段。这样的思路为经济法保障市场信用建立了坚实的理论基础。本文以比较的方法证成了如下结论:民商法对市场信用保障功能的缺失现状是经济法对市场信用保障的必要性基础。这样的思考,揭示了经济法对市场信用的保障是市场经济法律制度发展的现实需要。经济法以一系列的制度建设作为对市场信用的直接保障,以对政府信用的维护作为对市场信用的间接保障,这两种手段缔造了经济法保障市场信用的可行性基础。本文主张建立信用征信制度、市场进退制度、市场监管制度、失信惩罚制度,从而实现经济法对市场信用的直接保障,同时又要加强政府经济管理行为的信息公开和行为运行规制,从而实现政府信用对市场信用的外部信用环境意义。本文这种直接保障与间接保障相配合的设计,必然会全面实现经济法对市场信用的保障。
[Abstract]:The market economy is the credit economy, the credit market is an important social capital. The credit market is defined from the perspective of law, discusses the market credit mechanism, reveals the law is the main means of the modern social market credit guarantee. Such ideas for economic law to safeguard the market credit established a solid theoretical basis. The method in this paper the comparison of the following conclusions: current situation of the market credit guarantee function of civil law is the necessity of economic law on the basis of market credit guarantee. This thinking, reveals the security of economic law on the credit market is the development of the legal system of market economy. The reality of economic law system construction as a series of direct protection of the credit market, as an indirect guarantee on the credit market to maintain the credibility of the government, the two kinds of means to create economic law protection. The feasibility of market credit This paper advocates the establishment of credit system, market entry and exit system, market supervision system, punishment system, so as to guarantee the realization of economic law directly on the credit market, while strengthening economic management behavior of the government information disclosure behavior and operation regulation, so as to realize the government with external credit environment significance to the market credit. With this design direct and indirect security guarantee, will be the full realization of the economic law of the market credit guarantee.
