海上保险下违反告知义务的法律后果问题研究

【摘要】： 海上保险下的告知义务是最大诚信原则的主要内容之一,该义务要求保险合同的当事人在订立海上保险合同之前按照法律规定、合同约定或行业惯例,如实告知其知道的与保险标的和承保危险有关的重要情况,以使合同的相对方做出正确的判断,决定是否与之订立保险合同,以何种条件订立保险合同。我国《海商法》第222,223条是关于海上保险中被保险人告知义务的规定。但由于这些规定的不完善,不具体,可操作性不强,所以在法律实务中也引发了诸多争议。本文试图从分析海上保险下违反告知义务的主客观条件入手,结合我国相关立法和英国《1906年海上保险法》的规定,对海上保险下违反告知义务的法律后果和损害赔偿做出详尽的分析和阐述,并以此来揭示我国现行立法下存在问题,希望能有助于我国海上保险立法的完善,促进海上保险业健康发展。本文共分为四个章节。第一章是关于告知义务的概述,对告知义务的含义、性质、履行主体等一系列问题做了简要的论述,为下文的展开做了铺挚。第二章是本文的重要组成部分。在这一章中,通过对保险人和被保险人这两个不同主体违反告知义务的论述,详细的阐述了在不同情况和不同标准下,保险合同的当事人违反告知义务的各种法律后果。在第三章中,文章结合了英国海上保险的相关判例和立法,根据民法的基本理论,论述了对于海上保险下违反告知义务的损害赔偿。本文的最后一章,则是在上文论述的基础上,对我国的海上保险立法提出建议。
[Abstract]:The obligation to inform under marine insurance is one of the main contents of the principle of maximum good faith, which requires the parties to an insurance contract to agree on a contract or trade practice in accordance with the provisions of the law before entering into a marine insurance contract. Truthfully inform them of the important information they know about the subject matter of insurance and the risk of underwriting, so that the opposite party of the contract can make a correct judgment and decide whether or not to enter into an insurance contract with it and under what conditions. Article 222,223 of the Maritime Law of China is about the obligation of the insured to inform the insured in marine insurance. However, due to the imperfection and inspecificity of these provisions, the operation is not strong. This paper attempts to analyze the subjective and objective conditions of breach of the obligation of notification under marine insurance, combined with the relevant legislation of our country and the provisions of the British Marine Insurance Law of 1906. This paper makes a detailed analysis and elaboration on the legal consequences of breach of the obligation of notification and compensation for damages under marine insurance, and in order to reveal the existing problems under the current legislation of our country, we hope to contribute to the perfection of the legislation of marine insurance in our country. To promote the healthy development of the marine insurance industry. This paper is divided into four chapters. The first chapter is an overview of the obligation to inform, the meaning of the obligation of notification, nature, performance of a series of issues such as a brief discussion, The second chapter is an important part of this paper. In this chapter, through the discussion of the insurer and the insured, two different subjects violate the obligation of informing, elaborated in different situations and different standards. In the third chapter, the article combines the relevant cases and legislation of British marine insurance, according to the basic theory of civil law, The last chapter of this paper is based on the above discussion, and puts forward some suggestions on the legislation of marine insurance in China.
