船舶承租人的海事赔偿责任限制问题研究

【摘要】: 随着海运业多元化的发展,海事赔偿责任限制主体的范围不断扩大。对海事赔偿责任限制制度影响最大的1976年《海事赔偿责任限制公约》将船舶承租人归入船舶所有人,赋予其责任限制的权利,但公约未明确规定承租人的范围和可限制责任的索赔的范围。本文主要以《1976年公约》和我国《海商法》的相关规定为背景,针对享受海事赔偿责任限制的船舶承租人的范围问题及可限制责任的索赔范围问题,结合航运和司法实践,运用历史分析、案例分析、立法比较的方法进行研究。在此基础之上,明确了享受海事赔偿责任限制的船舶承租人的范围以及限制性债权的范围,最后提出对我国《海商法》的相关修改建议。 全文共分四个章节:第一章通过对相关国际公约和国内外立法的研究,以及对典型案例的分析,总结出了实践中亟待解决的两个问题,即本文的探讨重点;第二章从海事赔偿责任限制的产生发展、设立意义及性质等相关理论问题入手,确立了判断海事赔偿责任限制主体的标准,即基于船舶的经营或收益的标准。同时结合各类承租人的性质与特征,分别判断他们是否可以成为海事赔偿责任限制的主体;第三章将能够享受海事赔偿责任限制的索赔分为三大类来具体分析限制性债权的范围;最后一章在前文研究的基础之上,对我国现行立法中的相关条文进行分析,并提出立法建议。 通过本文的研究,笔者得出以下几点结论:(1)现今,海事赔偿责任限制主体享受责任限制的法理基础是基于对船舶的经营或收益;(2)能够享受海事赔偿责任限制的船舶承租人应当包括光船承租人、定期承租人、航次承租人以及舱位承租人;(3)结合《海商法》第207条的规定和各类责任主体自身的性质和特征,完全可以判断出责任主体对某一类海事请求是否可以享受海事赔偿责任限制,因此,对于《海商法》第207条的规定应当继续维持。
[Abstract]:With the diversified development of maritime industry, the scope of the subject of limitation of liability for maritime claims is expanding continuously. The Convention on limitation of liability for Maritime claims of 1976, which has the greatest influence on the system of limitation of liability for maritime claims, classifies the charterer as the owner of the ship. However, the scope of the lessee and the scope of the claim for the limitation of liability are not clearly stipulated in the convention. This article mainly takes the Convention of 1976 and the relevant provisions of the Maritime Law of China as the background. In view of the scope of the charterer who enjoys the limitation of the liability for maritime claims and the scope of the claim for the limitation of liability, combined with shipping and judicial practice, historical analysis and case analysis are used. On the basis of this, the scope of charterers who enjoy the limitation of liability for maritime claims and the scope of restrictive claims are clarified. Finally, some suggestions for amending the Maritime Law of China are put forward. The full text is divided into four chapters: the first chapter through the relevant international conventions and domestic and foreign legislation, as well as the analysis of typical cases, summed up the practice of two urgent problems, that is, the focus of this paper; The second chapter starts with the related theoretical problems, such as the emergence and development of the limitation of liability for maritime claims, the significance and nature of the establishment and so on, and establishes the criteria for judging the subject of the limitation of liability for maritime claims. That is to say, based on the standard of ship operation or profit, combined with the nature and characteristics of all kinds of charterers, whether they can be the subject of limitation of liability for maritime claims; The third chapter will be able to enjoy the limitation of maritime claims claims into three categories to specifically analyze the scope of restrictive claims; the last chapter on the basis of the previous study, the current legislation of our country to analyze the relevant provisions, And put forward legislative suggestions. Through the study of this paper, the author draws the following conclusions:. The legal basis of the limitation of liability for maritime claims is that the charterer who can enjoy the limitation of liability for maritime claims shall include the bareboat charterer and the time charterer. Combined with the provisions of Article 207 of the Maritime Law and the nature and characteristics of all kinds of subjects of responsibility, it is entirely possible to judge whether the subject of responsibility may enjoy the limitation of liability for a certain type of maritime claim. Therefore, the provisions of article 207 of the Maritime Code shall continue to be maintained.
