国际多式联运经营人责任法律制度研究

【摘要】: 国际货物多式联运是不同于其他运输方式的一种新型运输方式,也是国际贸易不可缺少的组成部分,并在世界经济发展中扮演着越来越重要的角色。但是,由于目前国际上缺少调整货物多式联运相对统一的法律制度,很大程度上制约着国际货物多式联运的进一步发展。因此,作为多式联运的核心体系,研究多式联运中经营人的责任并制订一套合理有效的体系,对解决目前法律适用混乱的局面以及促进多式联运的发展,都是具有积极意义的。 本文在中国加入WTO、加快对外开放与完善国内法律法规的背景下,将相关法学理论与国际货物多式联运的业务实践及我国具体情况相结合,围绕着当前国际立法上现存的三个多式联运规则:ICC1973规则、MTC1980、UNCTAD/ICC1992规则展开;以民商法和运输法的基本理论为依据,明确了多式联运经营人的法律地位后,以多式联运经营人责任类型、责任期间、赔偿责任基础、赔偿责任限制及免责事由为中心进行分析论证;采用经修订的统一责任制,将严格责任原则作为多式联运经营人的归责原则更加符合国际多式联运的发展趋势。同时在比较不同国际公约和惯例对有关多式联运经营人责任制度规定的优缺点后,文章认为建立一个完善的多式联运经营人责任制度体系,逐渐使我国立法与国际通行做法相协调,才能最大程度协调货运双方利益,使我国多式联运经营人责任制度尽快适应经济发展并与国际接轨。
[Abstract]:International multimodal transport of goods is a new mode of transport, which is different from other modes of transport. It is also an indispensable part of international trade and plays an increasingly important role in the development of the world economy. Due to the lack of a relatively uniform international legal system to adjust multimodal transport of goods, which to a large extent restricts the further development of international multimodal transport of goods, it is the core system of multimodal transport. It is of positive significance to study the responsibility of the operator in multimodal transport and to establish a set of reasonable and effective system to solve the confusion in the application of law and to promote the development of multimodal transport. Under the background of China joining WTO, speeding up opening to the outside world and perfecting domestic laws and regulations, this paper combines the relevant legal theories with the business practice of international multimodal transport of goods and the specific conditions of our country. Around the three existing multimodal transport rules in current international legislation: ICC1973 rule and UNCTAD / ICC1992 rule MTC1980. Based on the basic theory of civil and commercial law and transport law, this paper clarifies the legal status of multimodal transport operator, and then defines the type of liability of multimodal transport operator. During the period of liability, the basis of liability, limitation of liability and reasons for exemption shall be the center of analysis and argumentation; the revised unified responsibility system shall be adopted. The principle of strict liability as the principle of liability of multimodal transport operators is more in line with the development trend of international multimodal transport. At the same time, after comparing the advantages and disadvantages of different international conventions and practices on the liability system of multimodal transport operators, The article thinks that only by establishing a perfect system of multimodal transport operator's liability system, and gradually harmonizing our country's legislation with international common practice, can we coordinate the interests of both parties to freight transport to the greatest extent. Make our country multimodal transport operator responsibility system to adapt to economic development and international integration as soon as possible.
