实际承运人研究

【摘要】: 实际承运人是《汉堡规则》和我国《海商法》中一项独具特色的法律制度,此一概念的设立,对于澄清错综复杂的国际海上货物运输法律关系,解决1924年《海牙规则》遗留的承运人识别问题,具有重要的理论和现实意义。但是到目前为止,相关的判例和学说还不够发达。本文运用比较法和法解释学的方法,,以《汉堡规则》和我国《海商法》的规定为依据,对实际承运人制度作一系统研究。本文第1章是关于实际承运人的概念分析,主要对其定义中的“委托”和“从事运输”的含义进行解释,同时介绍了美国1999年COGSA草案中的运输主体概念。第2章是关于承运人识别问题的研究,介绍了该问题产生的原因,考察了采纳《海牙规则》或者《海牙—维斯比规则》的国家根据提单识别承运人的基本情况,最后着重分析了《汉堡规则》和我国《海商法》下的承运人认定。通过本章分析可以看到,《海牙规则》和《汉堡规则》及我国《海商法》对承运人的界定有着本质的不同。第3章概括了认定实际承运人的几种情况,并分析了实际承运人与联运的关系。第4章是关于实际承运人与相关当事人之间的法律关系的系统阐述,包括实际承运人与收货人、托运人、承运人、其他实际承运人之间的法律关系。期望通过本文的研究,为完善我国的实际承运人立法、指导司法实践提供有益的参考。
[Abstract]:The actual carrier is a unique legal system in the Hamburg rules and the Maritime Law of China. The establishment of this concept will clarify the complicated legal relationship between the international carriage of goods by sea. It is of great theoretical and practical significance to solve the carrier identification problem left over by the Hague rules in 1924. However, up to now, the relevant cases and doctrines are still not developed. This paper uses the methods of comparative law and legal hermeneutics. Based on the provisions of the Hamburg rules and the Maritime Law of China, this paper makes a systematic study on the actual carrier system. The first chapter of this paper deals with the conceptual analysis of the actual carrier. This paper mainly explains the meaning of "entrustment" and "engaged in transport" in its definition, and introduces the concept of the subject of transport in the draft of COGSA of 1999 in the United States. Chapter 2 is a study on the problem of carrier identification, and introduces the causes of the problem. Having examined the basic circumstances in which the country adopting the Hague rules or the Hague-Visby rules identifies the carrier on the basis of a bill of lading, Finally, the carrier identification under the Hamburg rules and the Maritime Law of China is analyzed emphatically. Through the analysis of this chapter, we can see that the definition of carrier in the Hague rules and Hamburg rules and the Maritime Law of China has its own meaning. Chapter 3 summarizes several situations in which the actual carrier is identified, Chapter 4 is about the legal relationship between the actual carrier and the relevant parties, including the actual carrier and the consignee, the shipper, the carrier. Through the research of this paper, we hope to provide a useful reference for perfecting the legislation of the actual carrier and guiding the judicial practice in our country.
