海运货损纠纷举证责任研究

【摘要】:2002年4月1日生效实施的《最高人民法院关于民事诉讼证据的若干规定》对各方当事人在诉讼中应承担相应的举证责任作出了明确的规定,同时也对法院的裁判标准作出了新的明确的要求。因此,举证责任,特别是举证责任的分配和证明标准,对于诉讼各方当事人及法官都显得尤为重要。 在海商海事案件中,海运货损索赔纠纷案件占有相当大的比例。本文所讨论的海运货损索赔案件主要是指就作为海上货物运输合同所涉及之载运货物所遭受的诸如灭失、损坏等相关损害所提起的索赔诉讼。本文以罗森伯格的法律要件分类说及我国《海商法》和关于海上货物运输合同相关国际公约的相关规定为法理依据,并结合联合国海上货物运输法草案及国内外诸多案例,分三章对海运货损索赔纠纷案件中各方当事人的举证责任分配原则及证明标准问题展开论述。 第一章首先对索赔人向法院提出索赔诉讼首先所应承担的举证责任进行了分析和阐述。索赔人欲主张赔偿,最重要的是应提供证据证明:货物发生了灭失或损坏,且该等灭失或损坏发生在承运人的责任期间。 第二章就承运人对货损原因的举证责任问题进行了分析阐述。本章分为六节,着重对目前海事审判实践领域及理论研究领域较为热门的诸如驾管船过失免责、火灾免责等几个方面的举证责任问题作了较为详细的阐述,并对中国《海商法》下是否适用“首要义务原则”之问题提出一些看法。 第三章主要就承运人的三大最低法定义务,即“谨慎处理使船舶适航”、“不得不合理绕航”、“管理和照料货物”的举证责任进行论述。 总之,对于海运货损索赔纠纷案件中举证责任问题的研究,实质上是对我国《海商法》第四章关于承运人责任制度之相关法律规定的研究,其中主要包括承
[Abstract]:In April 1, 2002 the implementation of the "Supreme People's Court on evidence of civil litigation of a number of provisions of the parties in the litigation should bear the burden of proof made clear, and also made a new explicit request to the court judgment standard. Therefore, the burden of proof, especially the allocation of the burden of proof and standard of proof. It is very important for the litigation parties and judges.
In maritime cases, marine cargo claims disputes occupies a large proportion. The cargo claim cases discussed in this article mainly refers to as suffered by the contract of carriage of goods by sea to carry goods such as loss, damage and other related damage claims. The relevant provisions of this law classification in Rosenberg said China's Maritime Law > and < and a contract of carriage of goods by sea the relevant international convention as the legal basis for the United Nations, and combined with the carriage of goods by sea bill and many domestic and foreign cases, the allocation of burden of proof of the parties in principle is divided into three chapters on marine cargo claim loss cases and the proof standard problems discussed.
The burden of the first chapter of the claim to the court to claim compensation first should bear are analyzed and explained. The claimant to claim compensation, the most important is to should provide evidence that: there is a loss of or damage to the goods, and the loss or damage occurred in the carrier's period of responsibility.
The second chapter is the burden of proof for the damage reason of the carrier are analyzed in this paper. This chapter is divided into six sections, focuses on the current field of maritime judicial practice and theoretical research of the popular areas such as driving ship fault exemption, expounds the fire exemption of burden of proof in several aspects, and the China < > is under maritime law and puts forward some views for "first obligation principle".
The third chapter mainly discusses the burden of proof of the three largest legal obligations of the carrier, namely, "careful handling of the ship's seaworthiness", "having to navigate properly," and "manage and take care of the goods".
