【摘要】：随着海上石油工业的发展,海上钻井平台数量不断增加,事故也频繁发生,导致严重的环境污染和人身损害。而目前我国对于人身损害赔偿的法律规定不够规范,民法领域仅有《工伤保险条例》、《关于审理人身损害赔偿案件适用法律若干问题的解释》等非法律性规定,海上人身损害赔偿方面只有《海商法》中的章节性规定,且存在不同身份不同赔偿的弊病。海上钻井平台造成人身损害赔偿法律缺失,对于受损方的利益保护不力。本文以现行法律规定为基础,从侵权损害赔偿的角度,构建海上钻井平台造成人身损害赔偿的责任体系。本文共分为4章：第1章主要是对海上钻井平台造成人身损害赔偿进行概述,首先是明确海上钻井平台造成人身损害赔偿的内涵,然后讨论海上钻井平台造成人身损害的属性与特殊性,并分析现有法律法规存在的问题。第2章是明确海上钻井平台造成人身损害赔偿责任的责任构成,确定可适用的归责原则、责任构成要素、以及免责事由。第3章主要是介绍海上钻井平台造成人身损害赔偿责任的主体,包括权利主体和义务主体。第4章的内容是海上钻井平台造成人身损害赔偿的范围与责任限制,明确精神损害赔偿的必要性,讨论责任限制的具体设置。
[Abstract]:With the development of offshore oil industry, the number of offshore drilling platforms is increasing and accidents occur frequently, resulting in serious environmental pollution and personal injury. In the field of civil law, there are only the regulations on Industrial injury Insurance, the interpretation of certain legal issues applicable to the trial of personal injury compensation cases, and other non-legal provisions, while the maritime personal injury compensation has only the provisions of chapters in the Maritime Code. And there are disadvantages of different status and different compensation. The law of personal injury compensation caused by offshore drilling platform is missing, and the interests of the injured party are not well protected. This paper, based on the existing laws and regulations, from the perspective of tort compensation, Construct the liability system of personal injury compensation caused by offshore drilling platform. This paper is divided into four chapters:. The first chapter is to summarize the compensation for personal injury caused by offshore drilling platform, first of all, to clarify the connotation of the compensation for personal injury caused by offshore drilling platform, and then to discuss the attributes and particularities of personal injury caused by offshore drilling platform. And analyze the existing problems of laws and regulations. The second chapter is to make clear the liability composition of liability for personal damage caused by offshore drilling platform, to determine the applicable principle of liability, the elements of liability, as well as the reasons for exemption. Chapter 3 mainly introduces the main body of the liability for personal injury caused by offshore drilling platform, including the subject of rights and obligations. The content of chapter 4 is the scope and limitation of compensation for personal injury caused by offshore drilling platform, the necessity of compensation for mental damage, and the concrete setting of limitation of liability.
