【摘要】:海运货物控制权是伴随国际贸易和运输的发展而产生的一项崭新的制度,联合国国际贸易法委员会(UNCITRAL)委托国际海事委员会(CMI)起草的运输法草案中,就对这一崭新的制度进行了规定。关于货物控制权的内容、性质、主体、行使及转让等问题,运输法草案的规定并非完善,在各界都还颇有争议,草案也仍有被修改的可能。本文以《UNCITRAL货物运输法草案》中有关货物控制权的规定为基础,对国际海上货物运输中的控制权进行了分析研究,对草案规定中的不合理之处提出了自己的意见,并在借鉴草案成功之处的基础上,结合我国的立法现状和司法实践,对在我国《海商法》中引入货物控制权制度提出了建议。 本文第一章分析了海运货物控制权产生的原因,并对之进行了定义。海运货物控制权受到重视,是因为其产生迎合了国际贸易法对运输法提出的新要求以及海运方式和运输单证发展的需要,它的出现也适应了司法实践的迫切需求。 第二章以《UNCITRAL货物运输法草案》中有关货物控制权的规定为基础,对国际海上货物运输中的控制权进行了分析研究,并在此基础上对《UNCITRAL货物运输法草案》中的不合理的规定提出了修改建议。 第三章分析了海运货物控制权与运输单证的关系。海上货物运输通常都会涉及到运输单证的签发和转让,而签发不同的运输单证应该适用不同的规则。本文按照未签发任何可转让运输单证或电子运输记录、签发可转让运输单证、签发可转让电子运输记录三种情况,分析了在这三种情况下货物控制权的行使主体、行使方式及其转让。 第四章对海运货物控制权和中途停运权进行了比较分析。虽然中途停运权是贸易法中的概念,但是海运货物控制权的产生却与该制度密切相关,它们之间存在着紧密的联系。同时,它们也是不同的法律制度,有很大的区别。对这两种制度进行比较分析,有助于更加准确地掌握海运货物控制权制度。 第五章在借鉴《UNCITRAL货物运输法草案》成功之处的基础上,结合我国的立法现状和司法实践,对我国《海商法》中引入货物控制权制度提出了建议。
[Abstract]:The right of control of goods by sea is a new system which comes into being with the development of international trade and transport. The United Nations Commission on International Trade Law (UNCITRAL) has entrusted the International Maritime Commission (CMI) with the preparation of the draft Law on Transport, which was prepared by the United Nations Commission on International Trade Law (UNCITRAL). Regarding the content, nature, subject, exercise and transfer of the right of control of the goods, the provisions of the draft Transport Law are not perfect and are still controversial in all walks of life. The draft is still possible to be amended. Based on the provisions of the draft of the UNCITRAL Law on the right of Control of goods, this paper analyzes and studies the right of control in the international carriage of goods by sea. The author puts forward his own opinions on the irrationality of the draft, and on the basis of drawing lessons from the success of the draft, combining with the present legislative situation and judicial practice of our country, puts forward some suggestions for introducing the system of control over goods in China's Maritime Law. In the first chapter of this paper, the author analyzes the causes of maritime cargo control, and defines it. Because it meets the new requirements of international trade law on transport law and the need of the development of shipping mode and transport document, it also meets the urgent need of judicial practice. The second chapter analyzes the right of control in the international carriage of goods by sea on the basis of the provisions of the draft Law on the Carriage of goods of UNCITRAL. On the basis of this, some suggestions are put forward to amend the unreasonable provisions in the draft of the UNCITRAL Law on the Carriage of goods. The third chapter analyzes the relationship between the right of control of maritime cargo and the transport document. The carriage of goods by sea usually involves the issuance and transfer of the transport document. Different rules should apply to the issuance of different transport documents. In this paper, there are three situations in which no negotiable transport document or electronic transport record is issued, a negotiable transport document is issued, and a negotiable electronic transport record is issued. This paper analyzes the subject, mode of exercise and transfer of the right of control of goods under these three conditions. Chapter 4th makes a comparative analysis of the right of control and stoppage of seaborne cargo. Although the right of stoppage is a concept in trade law, the emergence of the right of control of seaborne cargo is closely related to this system. At the same time, they are also different legal systems, there are great differences. A comparative analysis of the two systems is helpful to grasp the maritime cargo control system more accurately. On the basis of drawing lessons from the success of the draft of UNCITRAL cargo Transport Law and combining the current legislative situation and judicial practice of our country, Chapter 5th puts forward some suggestions on the introduction of the system of control over goods in Maritime Law of China.
