【摘要】：外国投资非商业风险 (有时亦称“政治风险”)保险是一种兼有私法与公法性质的综合法律关系。其保险人包括 :作为私法组织的国内保险公司、国家保险代理人和国际代理人。前者与后两者最明显的区别在于解决代位求偿问题。非商业风险多与接受投资国直接或间接的行为有关 ,有些战争与内乱风险除外。非商业风险保险的保险利益 ,即该保险法律关系客体 (标的 )是保全外国投资的利益。存在保险利益的投资范围是受有关保险代理人的实际做法和规章限制的 ,如对投资种类的限制、保赔数额的限制。虽然如此 ,非商业风险保险依然是一项基本的民商法制度 ,它可以有效地为海外投资提供法律保护
