海上保险的保险利益研究

【摘要】： 我国《海商法》对保险利益的概念、转让、确定及其对保险合同效力的影响方面,均未做出规定,但《保险法》关于保险利益的规定明显和海上保险中的保险利益原则不符。我国《保险法》在传统上被认为是大陆法的继受,但是《海商法》又深受英美法实证法律价值观的影响,此种特性在《海商法》保险利益原则上表现的非常突出。在司法实践中往往导致出现大陆法系的概念和术语解释英美法的现象,使得海上保险在适用保险利益原则时产生诸多法律问题。本文以海上保险中的保险利益原则为研究对象,首先阐述保险利益的基本情况,其次对海运货物的保险利益和船舶的保险利益问题进行研究,第三部分提议在我国海上保险中应该采用经济利益原则,最后对我国海上保险立法做出若干建议。
[Abstract]:The maritime law of our country has not stipulated the concept, assignment, determination and effect on the validity of insurance contract of insurance interest. However, the provisions of the Insurance Law on insurance interests are obviously inconsistent with the principle of insurance interests in marine insurance. China's Insurance Law has traditionally been regarded as a successor to continental law. However, the Maritime Law is deeply influenced by the values of the empirical law of the United States and the United States. This characteristic is very prominent in the principle of "Maritime Law" insurance interest. In judicial practice, it often leads to the phenomenon of the concept and terminology of civil law system explaining Anglo-American law. This paper takes the principle of insurance interest in marine insurance as the research object, first of all, it expounds the basic situation of insurance interest. The third part proposes to adopt the economic benefit principle in our country's marine insurance, and finally makes some suggestions to our country's marine insurance legislation.
