海难救助人财产损害赔偿责任研究

【摘要】:海难救助制度是海商法特有的重要制度之一。创立海难救助制度的目的是鼓励海难救助,为海上人命和财产安全提供另一份保障,从创始至今,海难救助制度一直发挥着重要作用。经过无数人的努力,海难救助方面的立法也得到了逐步的完善。但是,对于不同合同下救助人的身份问题、救助人在救助过程中由于过失导致被救助人损害的侵权责任问题,国际公约和各国国内法一直没有进行明确规定,学术界也没有形成一致的意见,因此有必要对这些问题进行讨论。本文从研究海难救助制度的产生及发展历程入手,通过分析、比较国际公约和各国国内法,对上述问题发表一点自己的看法。本文分为五部分。 第一部分,通过介绍海难救助制度的定义、海难救助的形式及其相关立法,是大家对海难救助制度有个初步的认识,为讨论下面问题做准备。 第二部分,本章通过分析光船租赁合同、定期租船合同下船舶所有人和承租人的权利义务及海上货物运输合同下合同双方的权利义务,然后就这些合同下救助人的救助报酬请求权的归属问题(即救助人的身份)发表自己的意见。 第三部分,通过研究国际公约和国内法,分析救助人是否应当对其在救助中的过错行为承担损害赔偿责任以及救助人承担损害赔偿责任的责任基础。 第四部分,从过错责任原则分析救助人侵权责任的构成要件。 第五部分,通过分析现行法律,简单探讨救助人损害赔偿的范围及计算问题;然后通过分析国际公约及我国的国内法,研究救助人是否应当享有责任限制,最后就不同情况下救助人责任限制的计算问题发表自己的意见。
[Abstract]:Salvage system is one of the most important systems in maritime law. The purpose of establishing salvage system at sea is to encourage salvage at sea and to provide another guarantee for the safety of life and property at sea. Since its inception, salvage system has been playing an important role. Through the efforts of countless people, the maritime salvage legislation has been gradually improved. However, with regard to the identity of the salvor under different contracts and the tort liability of the salvor for damages caused by negligence in the salvage process, the international conventions and the domestic laws of various countries have not clearly stipulated it. There is no consensus in academia, so it is necessary to discuss these issues. This paper begins with the study of the emergence and development of the salvage system at sea, compares the international conventions with the domestic laws of various countries, and puts forward some views on the above issues. This paper is divided into five parts. The first part, by introducing the definition of salvage system, the form of salvage at sea and its relevant legislation, it is a preliminary understanding of the salvage system for the purpose of preparing for discussion of the following issues. In the second part, this chapter analyzes the rights and obligations of the owner and charterer of the vessel under the bareboat charter contract, the term charter contract and the rights and obligations of both parties under the contract of carriage of goods by sea. Then the author puts forward his own opinion on the ownership of the salvor's right to compensation for salvage under these contracts (that is, the identity of the salvor). The third part, through the study of international conventions and domestic law, analyzes whether the salvor should bear the liability for damage compensation for his fault act in the salvage and the liability basis for the salvor to bear the liability for damages. The fourth part, from the fault liability principle analysis rescuer tort liability constitution. The fifth part, through the analysis of the current law, simply discusses the scope and calculation of the salvor's damages, and then through the analysis of the international conventions and domestic law of our country, the author studies whether the salvor should enjoy the limitation of liability. Finally, the author puts forward his own opinion on the calculation of the limitation of the rescuer's liability under different circumstances.
