海上集装箱货物损害责任归属之研究

【摘要】：海上集装箱运输已成为海上货物运输的一种重要方式,其在国际贸易中所扮演的角色日益重要。然而这种运输方式,也给海商法学界提出了许多新的问题, 其中海上集装箱货物损害的责任归属问题便是集装箱运输中亟待解决的法律问题之一。这个问题的解决对集装箱运输业的良性发展具有重要的理论意义和实践意义,而且对完善我国海上货物运输法律体系也具有着重要的理论意义。本文的写作目的是通过系统地分析,理清集装箱货物损害责任归属中的部分问题,即集装箱瑕疵所造成的货损的责任归属问题和集装箱货物“隐蔽损害”的责任归属问题。文章结合我国目前航运实践中和司法审判工作中的问题,从集装箱运输的交接方式和承运人的责任期间等方面入手,针对集装箱瑕疵所致货损的责任问题,和货物“隐蔽损害”的责任问题进行了深入地分析,以期能解决现实中的法律问题,并为完善我国集装箱运输方面的法律提出了自己的建议。
[Abstract]:Container transport by sea has become an important way to transport goods by sea, which plays an important role in international trade. The role played is becoming increasingly important. However, this mode of transportation has also raised many new questions for the maritime law community. Among them, the problem of liability for damage to container cargo at sea is the legal problem to be solved urgently in container transportation. One of them. The solution of this problem is of great theoretical and practical significance to the benign development of container transportation industry. It is also of great theoretical significance to improve the legal system of China's maritime cargo transport. The purpose of this paper is to clarify the parts of the liability for damage caused by container cargo through systematic analysis. The problem, that is, the liability for the damage caused by the defective container and the "hidden damage" caused by the container cargo Attribution of responsibility Combining with the problems in shipping practice and judicial trial in our country, this paper discusses the problem of assembling and assembling. With regard to the mode of delivery of the container and the period of the carrier's liability, the damage caused by the defect of the container is discussed. The problem of liability and the liability for "hidden damage" of goods are deeply analyzed in order to solve the problem of reality. In order to improve the legal aspects of container transport in China, the author puts forward his own suggestions.
