海商法案例文本翻译实践报告

【摘要】：随着我国对外开放的不断深入,海洋权益日益凸显出它的重要性。海商法作为一种重要的维护海洋通商权益的法律,受到国内各界的关注。我国是受理海事海商案件数量最多的国家,而我国海商法起步晚,相关人才匮乏,与国际海运和贸易先进的国家差距很大。因此,学习和研究先进国家的海商法,包括具体的案例审判,已经成为翻译工作者和法律工作者的重要课题。本报告源文本基于一则来自于劳氏法律报告刊载的海商法案例。2014年5月,本案例由英国高等法院后座分庭的大法官安德鲁史密斯主审,案例文本记录了审判的全过程。本案例文本编撰体例为:案名;案情概要;争议的焦点;法官的判决和理由。本案例文本在一定程度上反映了英国海商法案例审判的基本特点,有一定的学术代表性和研究价值。为了保证本报告的高质量和严谨的学术要求,在翻译及撰写报告过程中笔者多次向数名专家和学者征询意见和建议,并反复认真修改。经过导师的多次审核,最后确定了本报告文本。本报告基于对此案例文本的翻译,对英美海商法案例判决书文本从句法、词法等方面进行初步的翻译研究,初步得出海商法案例中专业术语、行为动词、情态动词、被动语态及虚拟语气等方面的基本翻译规律。通过翻译源文本并撰写翻译实践报告,笔者将努力达到以下目标:帮助法律工作者对英美国家海商法审判过程,审判逻辑等初步了解;研究海商法案例用语,从而探索海商法案例翻译的一般规律,用以指导翻译实践。
[Abstract]:With the deepening of China's opening to the outside world, marine rights and interests increasingly highlight its importance. As an important law to safeguard the rights and interests of maritime commerce, maritime law has been concerned by all walks of life in China. Our country is the country that accepts the most maritime business cases, but the maritime law of our country starts late, the related talents are scarce, and it is far from the advanced countries of international shipping and trade. Therefore, studying and studying the maritime law of advanced countries, including specific case trials, has become an important topic for translators and lawyers. The source text of this report is based on a maritime law case published in the Lloyd's Law report. In May 2014, this case was brought by Justice Andrew's in the back Chamber of the High Court of England. Smith presiding, the text of the case records the whole course of the trial. The method of compiling the text of this case is as follows: the case name; the brief of the case; the focus of the dispute; the judge's judgment and reasons. To a certain extent, the text of this case reflects the basic characteristics of the case trial of British maritime law, and has certain academic representativeness and research value. In order to ensure the high quality and strict academic requirements of this report, the author has repeatedly sought the opinions and suggestions of several experts and scholars during the process of translation and writing of the report, and has repeatedly and conscientiously revised it. After many times of review by the mentor, the text of this report was finalized. Based on the translation of the case text, this report makes a preliminary study on the translation of the judgment text from the syntactic and lexical aspects, and draws a preliminary conclusion of the specialized terms, behavioral verbs and modal verbs in the maritime law cases. The basic translation rules of passive voice and subjunctive mood. By translating the source text and writing the translation practice report, the author will strive to achieve the following goals: to help legal workers understand the maritime law trial process and trial logic of British and American countries; and to study the case terms of maritime law. In order to explore the general law of maritime law case translation, to guide the translation practice.
