商人自治组织的发展及相关法律思考

【摘要】：商人自治组织并非新鲜事务,其产生发展至今也有一段不短的历程,但是在当今研究商人自治组织却有着非常特殊的意义。随着经济全球化不断加深,我国加入WTO,商人自治组织在我国经济改革过程中起着举足轻重的作用。商人自治组织在发展中形成的商人自治规范,不仅对组织内部成员事务有约束、指引作用,其对商法在治理整个商业秩序过程中也起着重要的补充作用。一些商法未能调整的领域由自治规范进行调整,有的自治规范还大量被国家赋予了强制力,上升到法律层面,为我国法律的不断健全添了一份力量。但商人自治组织也需要不断完善与重构,才能跟得上经济改革的步伐。对于我国的商人自治组织,要吸收国外自治管理的精华,结合我国实际情况,探讨制定出适应我国国情的商会行会法律规范。并可据此协调我国行业内部关系,促进我国商人自治组织的发展。总之,我国社会主义市场经济时期,在党的领导和政府支持下,正确确定我国商人自治组织的性质,并为其定好位,使其健康、良好的发展,是另我国经济发展到一定高度不可缺少的关键问题。本文正是从以上方面综合论述,运用马克思主义的分析方法,试能为改革开放以来我国商人自治组织的发展及自治规范的健全在理论上有所研究,终能在实际中得以应用。
[Abstract]:The Merchant Autonomous Organization is not a new affair, and its emergence and development still have a long history, but the study of Merchant Autonomous Organization has a very special significance. With the deepening of economic globalization and China's entry into WTO, self-governing organizations of businessmen play an important role in the process of economic reform. The rules of Merchant Autonomy formed in the development of the Merchant Autonomous Organization not only restrict and guide the internal affairs of the members of the organization, but also play an important supplementary role to the commercial law in the process of governing the whole business order. Some areas of commercial law which can not be adjusted are adjusted by autonomy norms, and some self-governing norms have been endowed by the state with a large number of coercive power, rising to the level of law, which has added a force to the continuous improvement of the law of our country. But the Merchant Autonomous Organization also needs to be perfected and reconstructed to keep up with the pace of economic reform. For the self-governing organizations of businessmen in our country, we should absorb the essence of foreign autonomous management, combine with the actual situation of our country, and discuss how to formulate the legal norms of chamber of commerce that adapt to the situation of our country. And can coordinate our country industry internal relations accordingly, promote the development of our country businessman self-governing organization. In a word, during the period of our socialist market economy, under the leadership of the Party and with the support of the government, we should correctly determine the nature of the self-governing organizations of businessmen in our country, and set a good position for them so that they can develop healthily and well. Is another our country economy develops to certain high indispensable key question. This article is from the above aspect comprehensive elaboration, uses the Marxism analysis method, may for our country merchant autonomous organization development since the reform and opening up and the autonomy standard sound in the theory has studied, finally can be applied in the practice.
