【摘要】:定期租船下超期还船损害赔偿问题一直以来都是租船运输中引起学界讨论和争议的焦点。目前各国关于定期租船基本上都是依据“合同自由”的原则进行,遵循意思自治,具有明显的实务性、灵活性和复杂性,在发生争议纠纷时很不容易处理,这使得超期还船损害赔偿问题没有确定和统一的解决办法。但是作为海上租船运输的必要环节,及时准确的计算超期还船的损害赔偿能保证出租人在发生超期还船的情况下成功得到相应的索赔,保障其利益不受损害,同时恰当的解决超期还船的损害赔偿争议也可以促进海上租船运输的稳定发展。因此,为维护租船运输双方的利益平衡和贸易环境稳定,本文以此为论题,从多角度,多层次,综合运用案例分析,逻辑推理,比较分析,分类说明等法学研究手段,以中英法律对比为视角,对中国法和英国法下的超期还船的具体问题进行细致分析,从而勾勒出了中国法和英国法下超期还船的责任承担和损害赔偿的大致体系,进一步为我国《海商法》的完善提出建议。除引言外,本文主要分为四个部分:第一部分从定期租船下超期还船的基本概念着手,探讨超期还船的认定标准——最后航次。这不仅能对超期还船有深刻的把握和认识,也为后文进一步研究超期还船的责任承担和损害赔偿做好铺垫;第二部分以超期还船产生的不同原因作为分类标准,深入研究中国法和英国法下承租人超期还船的责任基础和免责的相关内容,从而进一步探讨不同情况下的超期还船的责任承担问题;第三部分也是文章的重点部分,从不同的角度来分析超期还船的损害赔偿问题,文章通过介绍中国法和英国法下超期还船的损害赔偿的一般原则和遥远损失的具体规定,从而构建出两国的超期还船损害赔偿体系,并展示出在特定情况下应如何来解决超期还船的损害赔偿问题;结论部分总结全文的整体框架并且对我国《海商法》关于超期还船损害赔偿的完善提出建议。
[Abstract]:The issue of compensation for damages caused by time charters has always been the focus of discussion and controversy in the field of charter ship transportation. At present, all countries basically carry out on the basis of the principle of "freedom of contract", follow the autonomy of will, have obvious practical nature, flexibility and complexity, and it is very difficult to deal with disputes in disputes. This makes there is no definite and unified solution to the problem of compensation for damages. However, as a necessary link of sea chartering, the timely and accurate calculation of damages for the overdue return of the ship can ensure that the shipowner can successfully obtain the corresponding claim in the event of the late return of the ship, so as to ensure that his interests will not be damaged. At the same time, the proper settlement of the dispute of damages for overdated ships can also promote the steady development of sea chartering. Therefore, in order to maintain the balance of interests between charters and carriers and the stability of the trading environment, this paper takes this as a topic, using case analysis, logical reasoning, comparative analysis, classification and other legal research methods from multiple angles, layers, comprehensive use, and so on. From the perspective of the comparison of Chinese and British laws, this paper makes a detailed analysis of the specific problems of overdated return ships under Chinese and British law, and then outlines the general system of liability and compensation for damages under Chinese and British law. Further put forward suggestions for the perfection of Maritime Law of our country. In addition to the introduction, this paper is mainly divided into four parts: the first part, from the basic concept of the term chartered ship to return the ship beyond the term, to discuss the criteria for the determination of the extended ship-the last voyage. This can not only have a profound grasp and understanding of the overdated return ship, but also pave the way for further research on the liability and damage compensation of the overdated return ship. The second part takes the different causes of the overdated return ship as the classification standard. The third part is also the key part of the article, by deeply studying the liability basis and exemption of the charterer under the Chinese law and the English law, so as to further explore the responsibility bearing of the overdated ship under different circumstances, the third part of which is also the key part of the article, and the third part is also the key part of the article. The article introduces the general principles of compensation for damages of overdated ships under Chinese and English law and the specific provisions of distant losses. In order to construct the damage compensation system of the two countries, and show how to solve the problem of compensation for damages under the specific circumstances; The conclusion part summarizes the whole frame of the paper and puts forward some suggestions on the perfection of the compensation for damages due to the late return of ships in Maritime Law of China.
