论海事赔偿责任限制制度的主体

【摘要】: 海事赔偿责任限制制度是海商法中的一项重要制度,它的出现保护了船舶所有人等对船舶具有利益关系的主体的合法权利,促进了航运业的不断发展。随着海事赔偿责任限制制度的不断发展,有关该制度的立法也逐渐统一并制定了相应的国际公约,在一定程度上使得海事赔偿责任限制制度实现了国际上的统一。许多学者对海事赔偿责任限制制度的存在持怀疑态度,但是我们从其不断发展的趋势来看,该制度的存在是有其合理性的,,而且在实践中也保证了海上运输业的健康有序的发展。因此,对海事赔偿责任限制制度进行分析也是必要的,该制度在海商法中占有十分重要的地位。 海事赔偿责任限制制度涉及的内容比较广泛,本文主要从其中最基本也是最主要的主体问题着手来分析,对海事赔偿责任限制制度进行了比较详尽的介绍,有关其他方面的内容在文章中也有所涉及。 文章分为三个部分,第一部分简单介绍了海事赔偿责任限制制度,对海事赔偿责任限制制度能有一个比较直观的概念性了解,主要叙述了海事赔偿责任限制制度的特征,并将其与相关概念进行了比较分析。 第二部分是本文的重点,从各国的立法和国际公约的相关规定入手,着重剖析了海事赔偿责任限制的各个主体,包括船舶所有人,船舶救助人,船舶所有人及救助人的雇用人,责任保险人,并探讨了无船承运人成为海事赔偿责任限制制度主体的可能性。文章在叙述主体的过程中,穿插阐述分析了海事赔偿责任限制制度中的其他部分重要内容。 第三部分则主要探讨的是我国相关法律法规对该问题的规定。在该部分中,笔者也是对海事赔偿责任限制制度的主体进行了逐个分析,分析了其不足之处,并提出了自己的建议。
[Abstract]:The limitation of liability for maritime claims is an important system in maritime law. Its appearance protects the legal rights of the subject with interest to the ship, such as the owner of the ship, and promotes the continuous development of the shipping industry. With the continuous development of the system of limitation of liability for maritime claims, the legislation of this system has been unified gradually and the corresponding international conventions have been formulated, to a certain extent, the system of limitation of liability for maritime claims has been unified internationally. Many scholars are sceptical about the existence of the limitation system of liability for maritime claims, but from the trend of its continuous development, the existence of the system is reasonable. And in practice, it also ensures the healthy and orderly development of the marine transportation industry. Therefore, it is necessary to analyze the limitation system of maritime liability, which plays an important role in maritime law. The content of the limitation system of maritime claim liability is quite extensive. This article mainly starts with the most basic and main body issues, and gives a detailed introduction to the limitation system of maritime claim liability. Other aspects are also covered in the article. The article is divided into three parts. The first part briefly introduces the limitation system of maritime claims liability, and has a more intuitive conceptual understanding of the limitation system of maritime claims liability, mainly describes the characteristics of the limitation system of maritime claims liability. It is compared with related concepts. The second part is the focus of this paper, starting with the legislation of various countries and the relevant provisions of international conventions, it focuses on the analysis of the main body of the limitation of liability for maritime claims, including the owner of the ship, the salvor of the ship, the owner of the ship and the employer of the salvor. Liability insurer, and explore the possibility of NVOCC becoming the subject of liability limitation system for maritime claims. In the process of describing the subject, this paper analyzes the other important contents of the limitation system of maritime claims liability. The third part mainly discusses the provisions of the relevant laws and regulations of our country. In this part, the author also analyzes the main body of the limitation system of maritime claims liability one by one, analyzes its shortcomings, and puts forward its own suggestions.
