完善我国网络游戏立法的思考

【摘要】： 我国的网络游戏产业在近几年里得到了突飞猛进的发展,创造了数亿元的销售收入,同时也带动了相关产业的发展。但与此极不相称的是如此巨大的产业却至今仍未有法律规范对其进行规制,被人称为正在蔓延的无规则游戏。现实中大量发生的有关网络纠纷,已经成为人们关注的焦点。在我国网络游戏立法明显滞后于网络游戏的发展,这给司法实践带来了许多不便,亦不能充分有效地保护广大游戏玩家的合法利益。因此,相关部门应当尽快地制定法规以维护行业的秩序,促进行业的发展。对网络游戏相关的民商法律问题及其规范进行研究,将拓宽传统民商法的视野,将传统的民商法理论延伸到网络游戏世界。首先是笔者以现有研究成果为基础,首先介绍了网络游戏的概念、特点及我国网络游戏市场现状和立法概况。在些基础之上,对我国网络游戏监管实践中存在的问题进行了剖析,这些问题既包括网络游戏立法中存在的问题,也包括网络游戏发展中存在的问题。最后,针对我国网络游戏立法的现状和相关问题,提出了完善我国网络游戏立法的三点具体建议,即明确网络游戏虚拟财产的法律性质、明确网络游戏运营商和玩家的权利和义务以及对网络游戏中“私服”、“外挂”行为的定性和打击。
[Abstract]:In recent years, the online game industry in our country has been developing by leaps and bounds, which has generated hundreds of millions of yuan of sales income, and has also led to the development of related industries. However, such a huge industry has not yet been regulated by law, which is regarded as a spreading game of irregularity. In reality, a large number of network disputes have become the focus of attention. In our country, the legislation of online game obviously lags behind the development of online game, which brings a lot of inconvenience to judicial practice, and can not fully and effectively protect the legitimate interests of the majority of gamers. Therefore, the relevant departments should make laws and regulations as soon as possible to maintain the order of the industry and promote the development of the industry. The research on the civil and commercial legal problems related to online games and their norms will broaden the vision of traditional civil and commercial law and extend the traditional theory of civil and commercial law to the world of online games. First of all, based on the existing research results, the author first introduces the concept, characteristics, current situation and legislative situation of online game market in China. On the basis of these, this paper analyzes the problems existing in the practice of supervision of online games in China. These problems include not only the problems existing in the legislation of online games, but also the problems existing in the development of online games. Finally, in view of the current situation and related problems of our country's online game legislation, three specific suggestions are put forward to perfect our country's online game legislation, that is, to clarify the legal nature of the virtual property of the online game. Make clear the rights and obligations of online game operators and players, as well as the "private" and "external" behavior in online games.
