【摘要】:国际集装箱多式联运是当代国际贸易和运输中的一大特色。然而,这种运输方式已不可避免的产生了一些新的问题:集装箱运输并不能保证货物完全不受损害,当发生货物积载不当、捆扎不牢或集装箱本身存在缺陷等情况时,货损也常常发生。此时,货损的索赔就比在传统运输方式下货损的索赔要麻烦,因为在传统的运输方式下,货物直接积载于船舱内,承运人可以对货物进行直观的、妥善的处理,货损也容易被发现,而集装箱运输由于经常是由承运人与托运人中的一方装箱,另一方很难了解到箱内货物的状况,所以对于某些货损的责任很难认定,特别是在多式联运的情况下,更会产生各阶段承运人与多式联运经营人的责任认定问题。其次,在集装箱运输中,各种事故的发生,会带来其他财产的损失,有时甚至是第三方的人身和财产的损害等。 目前,由于国际集装箱多式联运大行其道,对于多式联运责任问题,已经引起了国内外学术界的注意。同时,这方面已经出现了许多案例,各大航运公司也十分重视由此引起的有关问题。另外,各项国际公约规定的不同增加了责任确定问题的复杂性。我国集装箱运输起步较晚,这方面还有待于经过实践再进一步完善。理论上,围绕多式联运责任问题存在着争议(比如:相关当事方的识别及责任确定),在实务中,也有不少亟待解决的问题,(例如:集装箱整箱货运输下的“隐藏损害”是目前航运界、贸易界、银行界、保险人共同关注的焦点,至今仍无统一的且不失公正的解决方法)。这些正是我国国际多式联运完善和发展之所在。 全文共分六章。 第一章为概述,涉及国际集装箱多式联运的概念、现状、优势,是全文的基础章节。 第二章对国际集装箱多式联运经营人和相关当事方的法律地位进行分析,并结合具体案例对实务中他们的识别问题进行了比较深入的研究。 第三章从国际集装箱多式联运的责任入手,论述了国际集装箱多式联运经营人和相关当事方(国际货运代理人和港站经营人)的归责原则、责任限制等一系列问题。这其中既包括对海商法学界已有成果的系统化,也补充了一些作者自己的理解。
[Abstract]:International container multimodal transport is a major feature of contemporary international trade and transport. However, this mode of transport has inevitably created some new problems: container transport does not guarantee that the goods will not be damaged at all, in the event of improper stowage of the goods, lack of bundling or defects in the container itself, etc. Damage is also common. At this point, the claim for damage is more troublesome than the claim for damage under the traditional mode of transport, because under the traditional mode of transportation, the goods are stowed directly in the cabin, and the carrier can handle the goods visually and properly. Damage is also easy to detect, and because container shipments are often packed by one of the carriers and shippers and the other party has difficulty understanding the condition of the goods in the case, it is difficult to establish liability for certain damage, Especially in the case of multimodal transport, the identification of the liability of the carrier and the multimodal transport operator will arise. Secondly, in container transportation, the occurrence of various accidents will lead to the loss of other property, sometimes even the third party's personal and property damage and so on. At present, because international container multimodal transport is popular, the problem of multimodal transport liability has attracted the attention of domestic and foreign academic circles. At the same time, there have been many cases in this area, the major shipping companies also attach great importance to the related problems. In addition, differences in the provisions of international conventions add to the complexity of the issue of responsibility determination. Our country container transportation starts late, this aspect still needs to pass through the practice to further consummate. In theory, there is controversy over the issue of liability for multimodal transport (e.g., identification of relevant parties and determination of liability, in practice, There are also many problems that need to be solved urgently (for example, the "hidden damage" under the container cargo transportation is the common focus of the shipping, trading, banking, and insurer circles. So far, there is still no uniform and fair solution to this problem. These are the perfection and development of international multimodal transport in China. The full text is divided into six chapters. The first chapter is an overview, involving the international container multimodal transport concept, status quo, advantages, is the basic chapter of the full text. The second chapter analyzes the legal status of international container multimodal transport operators and related parties, and combined with specific cases to study their identification in practice. The third chapter starts with the liability of international container multimodal transport, and discusses a series of problems such as the imputation principle of international container multimodal transport operator and related parties (international freight forwarder and port station operator), liability limitation and so on. This includes the systematization of the existing achievements in the field of maritime law, as well as the author's own understanding.
