论提高法律移植的效用

【摘要】： 法律移植现象从很久远的年代开始就已经存在于人类的历史中了。但是,从历史上来看,并不是每一次法律移植都是有效的和成功的。因此,如何提高法律移植的效用就成为了一个必须予以关注的问题。具体来讲,提高法律移植的效用有以下几个重要作用:第一,节约社会成本;第二,保证国家法律体系的完整性;第三,增强人们对法律移植的信心。法律移植的效用如何,是成功还是失败,直接涉及其判别的标准是什么。笔者认为,可以分别从以下几方面进行判别:第一,移植的法律是否符合接受国自身的社会发展的需要;第二,移植的法律是否与本土的法律相协调、相融合发展;第三,移植的法律是否有所改进或创新,并产生了积极的作用;第四,移植的效用还需要从长时间来考察。影响法律移植效用的因素主要有:第一,经济因素。从美国移植英国法的历史以及商法的发展中我们可以看出经济因素的作用;第二,政治因素。从近代以后英、法、德、日等国的法律移植中可以看出政治因素的作用;第三,文化因素。从近代日本的法律移植中可以看出文化因素的作用。具体应该怎样做才能提高法律移植的效用呢?笔者认为有以下几点是值得注意的:第一,选择适合的对象;第二,采取法理移植、立法移植和司法移植相结合的整体移植方式;第三,处理好法律移植过程中的本土化问题。
[Abstract]:The phenomenon of legal transplantation has existed in human history since a long time ago. However, historically, not every legal transplant was effective and successful. Therefore, how to improve the effectiveness of law transplantation has become a problem that we must pay attention to. Specifically, improving the effectiveness of law transplantation has the following important functions: first, to save social costs; second, to ensure the integrity of the national legal system; third, to enhance people's confidence in legal transplantation. What is the criterion directly related to the effectiveness, success or failure of legal transplantation. In my opinion, we can distinguish from the following aspects: first, whether the transplanted law meets the needs of the recipient country's own social development; second, whether the transplanted law is coordinated with the local law and develops in harmony; third, Whether the law of transplantation has been improved or innovated, and has produced positive effect; fourth, the utility of transplantation also needs to be examined from a long time. The main factors affecting the effectiveness of legal transplantation are: first, economic factors. From the history of American transplantation of English law and the development of commercial law, we can see the role of economic factors; second, political factors. The role of political factors can be seen from the transplantation of laws in Britain, France, Germany, Japan and other countries after modern times; third, cultural factors. The role of cultural factors can be seen from the transplantation of laws in modern Japan. What should be done to improve the effectiveness of law transplantation? The author thinks that the following points are worthy of attention: first, choose the suitable object; second, adopt the whole transplant mode of combining the legal theory transplantation, legislative transplantation and judicial transplantation; third, deal with the localization problem in the process of legal transplantation.
