论不动产公示公信与第三人利益的保护

【摘要】: 物权变动涉及财产的涌流,关乎一国的交易秩序,而物权变动中第三人利益的保护问题历来是理论界研究的热点,因为第三人利益的保护既是市场经济得以健康发展的基础,也是现代民商法之重要价值关怀。笔者通过分析,认为第三人利益的最大威胁来源于原物权的排他性。因此,阻断原物权的排他性,切断前手的追夺,从而确定地取得交易中的物权并保有所取得的利益,就成为第三人在交易过程中最基本的利益要求。而公示公信在满足这一要求的基础上,能以善意恶意为参数实现不同利益之间的灵活保护,还能以客观善意作为判断标准解决实际操作中的难题,具有制度上不可比拟的优越性。鉴于此,笔者提出应该以公示公信为核心来建构第三人利益保护制度体系的观点,而本文也正是围绕着这一观点展开的。
[Abstract]:The change of real right involves the flow of property and the transaction order of a country. The protection of the interests of the third party in the alteration of real right has always been a hot topic in the theoretical circle, because the protection of the interests of the third party is the basis for the healthy development of the market economy. It is also an important value concern of modern civil and commercial law. The author thinks that the greatest threat to the interests of the third party comes from the exclusivity of the original real right. Therefore, blocking the exclusiveness of the original real right, cutting off the capture of the former hand and obtaining the real right in the transaction and retaining the interests obtained are the most basic interests requirements of the third party in the course of the transaction. On the basis of satisfying this requirement, public information can realize the flexible protection between different interests with the parameter of goodwill and malice, and can take objective goodwill as the criterion to solve the difficult problems in practical operation. Has the system incomparable superiority. In view of this, the author puts forward the idea that public information should be taken as the core to construct the system of protecting the interests of the third party.
