不真正连带债务若干实务问题研究

【摘要】：不真正连带债务是民商法领域中一个独立的法律概念,文章首先从案例引出了司法实践中审理不真正连带债务案件出现的问题和困境,并从解决问题的角度出发,明确了不真正连带债务的概念和特征,归结了我国现行法律和司法解释中具有不真正连带债务性质的法律条文,比较了不真正连带债务与类似概念的联系和区别,分析了不真正连带债务的各种类型和对内对外的法律效果,从诉讼程序和实体处理等方面总结了审理不真正连带债务案件的一些操作方法和规则,试图解决司法实践中审理该类案件出现的问题。
[Abstract]:Non-real joint and several debts is an independent legal concept in the field of civil and commercial law. Firstly, the article leads to the problems and difficulties in the judicial practice of handling cases of non-real joint and several debts, and starts from the angle of solving the problems. This paper clarifies the concept and characteristics of the unreal joint and several liabilities, summarizes the legal provisions in the current legal and judicial interpretations of the non-real joint and several liabilities, and compares the relations and differences between the non-real joint and several obligations and similar concepts. This paper analyzes the various types of unreal joint and several liabilities and their legal effects on internal and external affairs, and summarizes some operational methods and rules for handling cases of unreal joint and several liabilities from the aspects of litigation procedure and substantive treatment. This paper tries to solve the problems in judicial practice.
