海上货物运输承运人责任归责原则问题研究

【摘要】:海上货物运输承运人的责任问题是海上货物运输法的核心,而其责任归责原则 问题就更是核心中的核心。它反映船货双方的利益关系,制约或者促进国际贸易和 海上运输业的发展,代表一个国家、地区甚至一个时代的主流思想和立法趋势。当 前,有关国际海上货物运输的法律很不统一,我国国内的沿海货物运输与国际海上 货物运输法律制度也不一致。 本文分为五个部分。第一部分介绍和分析责任归责原则的基本理论。在这部分里, 本文定义了国际海上货物运输承运人的归责原则,分析了几种归责原则在海上货物运 输领域的影响,并对海上货物运输承运人责任归责原则的确定方法和评价标准做了初 步的探讨。在第二部分中,本文对现行国际公约及法律对海上货物运输承运人责任归 责原则的规定作出评价和分析。第三部分与第四部分对我国《海商法》和我国沿海货 物运输法律中有关责任归责原则的部分做出评价,认为目前在我国《海商法》中取消 不完全过错责任原则并不妥当。第五部分对我国国际海上货物运输与沿海货物运输法 律制度的统一提出建议,认为应当将国内水路货物运输纳入《海商法》,均采取不完 全的过错责任原则,并且在适当的时机再修改为完全过错责任原则。 希望本文能够对我国《海商法》中国际海上货物运输承运人责任部分的修改以及 完善我国沿海货物运输承运人责任问题提供理论参考,以便完善《海商法》对此问题 的相关规定,进而达到统一立法及便利司法实践的目的。
[Abstract]:The liability of the carrier in carriage of goods by sea is the core of the law of carriage of goods by sea, and the principle of liability fixation.
The problem is also the core of the core. It reflects the interests of both sides and restricts or promotes international trade.
The development of marine transportation represents the mainstream ideology and legislative trend of a country, region and even an era.
Before, the laws concerning international carriage of goods by sea are very different.
The legal system of freight transport is also inconsistent.
This article is divided into five parts. The first part introduces and analyzes the basic theory of liability imputation principle.
This article defines the principle of imputation of the international carriage of goods by sea, and analyzes several principles of liability fixation in the carriage of goods by sea.
The influence of the field of transportation and the determination method and evaluation standard of the liability principle of carrier's carriage responsibility were introduced.
In the second part, this article is responsible for the current international conventions and laws' liability for the carriage of goods by sea.
The third part and the fourth part of China's maritime law and China's coastal commodities.
In the law of transportation of goods, the part of the principle of liability fixation is evaluated, and it is considered to be abolished in China's maritime law.
The fifth part is about the law of international carriage of goods by sea and the law of the carriage of goods by sea.
The unification of the legal system suggests that domestic waterborne freight transport should be included in the maritime law.
The principle of fault liability should be amended and the principle of total fault liability should be amended at the right time.
It is hoped that this article will be able to amend the liability part of the international carriage of goods by sea in China's maritime law.
This paper provides a theoretical reference for improving the liability of carriers in China's coastal cargo transportation, so as to perfect the maritime law.
The relevant provisions, in order to achieve the purpose of unified legislation and facilitate judicial practice.
